Vehicle rejection help

Clutch judder was there day of delivery told him via WhatsApp I paid bank transfer and listed it was to make a purchase no repairs elsewhere only
Air con garage agreed to have clutch fixed at my local garage but I think they won’t really pay for it to be done and I am
Stuck with the bill then
 
How soon into the ownership was the clutch judder and engine vibration start happening and did any of these probelms show up on the test drive?

Seek legal advice but surely the OP should be able to get a refund due to them refusing to fix the car unless he signs away his legal rights. They cant fix the issue(s) in good faith and know the cars a lemon and they've been fobbing you off for 3 months...
Vibration I have more picked up the last couple months but they haven’t commented on that. Typically test drive nothing showed but the test drive was really really short and the engine was cold and I’ve noticed that the clutch seems to happen when the engine is warm. That’s how I noticed when the car was delivered to me but there was a clutch because the engine was hot by then and I text him straight away to let him know and he said what do you want me to do? It’s a used car

If you reported a fault with the clutch on the day of delivery, and you did so in writing (via whatsapp), then they must repair it, consumer rights act has you covered here, as this happened in the first 30 days. (because you reported it on day 1, the clock stopped at that point, even though it's now months later)

It's really that simple (which is why they're offering to repair it, because they know they have to and the fault was present at the point of purchase)

My thoughts would be to accept the repair, and if you're still not happy - P/X the car and move on to cut your losses.

You may have the right to reject here, because you notified them about the fault on the day of delivery, but in all honesty - for a juddering clutch, I wouldn't go that far - rejecting a car is a long difficult drawn out process and should be used as a last resort (so for example the car's engine blew up)

I'd agree with @Felon - get them to replace the clutch, and if you still have no confidence in the car then move it on.

You can mention to them that they cannot demand that this is the final settlement with the car - legally they can't do this, but unless you are prepared to fight it in small claims court, there isn't much you can realistically do.
 
id guess the pulling back lack of power is down to a diesel filter needing to be changed. tbh i always rated the sportage and we have a 2014 in the family.
trouble is when the garage start playing silly devils you feel like a uphill battle. as others have said maybe time to get rid (wbac offer?)
 
thanks guys. garage who is going to do the clutch repair Give the car a good check over today plugged in the diagnostics and he couldn't find anything. He says there was no fault codes which is a bit frustrating when I know that it's driving a bit strange, he told me to fill up with the vpower at a Shell garage which I have done and to be fair it did for the little journey had done felt a bit more of a smoother drive. Fingers crossed it’s ok as fed up of not enjoying my car. Sold a lovely bmw for this too it did have a new oil leak but was a fixable one and someone in my street has it now and I regret selling it lol

Im wondering if to give it a full service and change all filters because I don’t know what services it’s had previously but chances are it’s probably just had to put up with oil and filter changes

My car felt better for having a major service last year, it’s booked in for this year’s service. It just drove smoother don’t know if I was imagining it.
