not sure
Hi all just a question if I may.

I wont go into to much detail but I purchased some thing not to long ago and its faulty.

I purchased the item from the bay ;).

Any way I contacted the manufacturer of the item not the bay seller as I thought it would be faster for a RMA etc.

I was told that because I never purchased it from an autorized dealer they will nmot honor the warrenty and I need to contact the dealer I got it from instead.

Is this allowed or just a way of getting out of a warrenty claim?.

Thanks

Yeah it does say you must purchase it from an auth dealer.

But I find this a huge loop hole tbh why should it matter its still there product.

They confirmed it was in warrenty by me giving them the serial number etc etc.

Because warranties are only normally valid for the original buyer. If you bought it from the 'bay and they weren't an authorised reseller it is classified as second-hand goods.

The law isn't on your side, take it up with the seller. (now you know why it was cheap on ebay).

its brand new the company i got it from sells every one of there products and has great feedback.

I will take it up with the bay company just wondering if this really is allowed it seems like it hinges on illegal tbh

whos to say they're not grey imports if they're not being sold by an authorised seller?

some company's take unauthorised grey imports seriously.

You're only entitled to the terms of the warranty - that's a danger in buying from sellers on sites like e-bay (or outside of the country) unfortunately. You need to take it up with the seller, not the manufacturer.

This always puzzled me. Warranty is manufacturers cover for the product they made. If the product is genuinely made by said manufacturer, why is the cover conditional upon retail place of sale having been authorised of even upon country of sale (like in case of cameras)? Why is me buying the very genuine product, then passing the item onto another party (either as a gift or as a customer) and thus "second hand"ing it in the process, suddenly strip the product from its cover? It is still the same product, made by the same manufacturer and it is still new? Why is this even legal for manufacturers to stipulate?

I understand it just seems like a very large loop hole.

Its new they confirmed that via serial number
its a genuin product of theres they confirmed that its not like a cheap knock off etc
its in warrenty they confirmed that to.

I sent them pics of it as well.

how else can they get their RRP pricing monopoly ?

Don't buy from an authorised dealer involved in a price fixing scam with the manufacturer = dirty thief

Agreed. It sucks.

If the manufacturer warrants the product to be free of defects for 3 years, then why does it matter who the current owner is and where they bought it from? Either the item is under 3 years old and has a fault, or it is not.

the worrying thing is the amount of these items that are sold and now could have zero warrenty as such.

I know they could contact the original seller but it really is a huge loop hole and tbh should not be allowed

yep worst of all you never know this till you visit the actual site that makes said item.

Its not even on the bay seller FAQ etc etc

I am sure this is clear but will just make sure

THIS HAS NOTHING TO DO WITH OCUK WHAT SO EVER

Grey import doesnt mean its fakes.
Grey import can mean that it was manufactured for a region/country which isnt the UK.

Legally you have no contract with the manufacturer. They dont have the honour anything. Your contract is with the reseller - the Sales of Goods Act confirms this.

The manufacturer doesn't have to do anything for you, its the reseller you should deal with.

Of course many manufacturers WILL deal with end users, but of course they may have internal policies etc which means soemtimes they wont help you.
