Hi

I purchased a bag in Dec 07, and the bag fell apart and was replaced in Sept 08. I only use this bag for holidays, so is used a couple of times a year. The bag has broken again (ie at seams, wheel falling off), the manufacture is saying tough look but your not replacing it. Have I got any rights regards to this? I'm guessing not.

Cheers

You could right a letter, but I think you mite be best getting someone to proof read it.

I doubt you'll get anything if you've already contacted the manufacturer and had the brush-off.

Write the CEO a letter stating that you have only used it twice and it has broken twice and is therefore clearly unfit for purpose. Politely ask for a refund or say you will take matters further.

It doesnt seem to state on the website, the company seems like a one man band. It's a small sports company, that makes and sells its own bags. I have tried email and phone call, both of which the company just reject and say no. I recall reading something about EU law regarding 'Fit For Purpose', does anyone know anything further about this? As even if it is indeed a one year warrenty, this does not seem much for a large holdall bag.

fit for purpose is subjective

if it was a 25 quid bag then you have probably have had fair use from it ( in terms of time, the how many times used would be impossible to prove )

if it was 300 quid then you can rightly expect better quality and it may well not be fit for purpose

Your best buying really cheap luggage and expect it to fail after one or two holidays as the cases get thrown around and take a lot of impact hits. Most expensive cases have no better way of protecting the case than the cheaper models.
