Was I at fault?

As has come up recently double yellow lines apply to the boundary of the carriageway in most cases - what isn't quite clear there is what the boundary is - if that area is designated for pedestrian through traffic it probably applies upto that fence/railings - which would even make leaning a motorbike up against the fence not legal parking.

Regardless though it would be very hard for her to prove that was your fault unless she could prove some kind of negligence on your part that meant it was impossible for her to avoid the accident.

It's a great illustration of why insurers load premiums for non fault accidents.

In terms of cars hitting it though, it doesn't seem badly parked. It's on a straight bit of road, and no closer to the traffic than it would be in a normal street parking bay. In fact, there's probably less risk of damage as there aren't any cars parked in front and behind, as there normally are when parking on the side of a road.

Her going on about you being illegally parked should work in your favour here, if that's the stance she takes when ringing her insurers she'll be admitting she hit your parked van, so they'll have to accept liability, whereas if she lied and said something like you pulled out on her it would go 50/50 without independent witnesses.
 
Were you in the van and the engine running at the time?
Of not then er... not quite sure how she expects to get away with this... i mean she could always say the van appeared out of nowhere but would then need to be seen but a shrink for being nuts.
If yes then.. well your bolloxed just because of those wheels... i think they are a bit naf... have you though of tri spokes :D;):p

Actually yes. Back when cars were much less reliable, a mate found himself in his car rolling backwards down a hill. He ran into a car that was illegally parked. He successfully argued to the judge that he would have been able to safely stop the car had the other vehicle not been there.

OTOH in this case the lass is clearly trying it on.
 
I had a woman start a 3 point turn as I was approaching at slightly above the limit.. I had enough time to hit the brakes and say stupid bi.....Before I hit her... She then calls the police, who attend. Telling the copper I was speeding so it was my fault...He explained to her that she needs to drop that accusation as she has just admitted to not only seeing me... But seeing me speeding and she still decided to pull out and block the road........

Drivers are stupid.......

make a mistake, Everyone does....Admit it and move on....

OP your in the clear mate.....She doesn't have a right to drive into your vehicle...

I reversed off a shop front and clipped a car years ago that was on a bend and on DBL yellows.......My fault....(yes I did try to use the illegal parking argument)
 
Am I best off ringing my insurance company up or going through a third party to claim for the repairs? :)

Ring HER insurance...

But if she's one to want to blame everyone but herself I'd probably just contact my own insurance......Or my mate who's an ambulance chasing lawyer........Wan't his number? I get a £200 kick back....lol
 
Seriously not your fault, but you are a hazard, parked so close to the junction and obscuring the view lines of people approaching or exiting the junction, particularly in a van. For a two wheel user you would be a plonker, no doubt.
 
Is that damage on her nearside rear quarter from this incident? Where was she parked? Is the exit to a car park just to the left of camera?

It looks like she has turned across your rear end and clipped it, terrible place to park a van. There looks to be places to park further up the road.

If so you are a tool regardless of being at fault or not.
 
I love how everyone can make assumptions based on 1 picture...

The poster above has stated that it look like there are places to park further up the road.....How do you know that....yes it looks like there is space when the op took that picture...But were their any spaces when the OP parked up......What are the parking restrictions on that road....Is the op parked illegally... Just because their are Dbl yellows on the carriageway doesn't mean he is parked illegally...

I’d bet money on what I just said is actually what happened. She’s doesn’t know the size of her car, but it looks like the double yellows are fairly new and there for a reason. See will take the hit, but he’s not totally innocent here.

He shouldn’t be parked there for any real reason and he knows that.

What’s with all the .........?
