It isnt an offence, you are perfectly fine to pass on the left providing you dont pull into the left lane specifically to overtake, his assertion that it is "driving without due care and attention" is wrong.
So long as you maintain your speed and dont accelerate, you are fine.

You'd think so, but everybody seems to go straight to 5th and get their pet pig to blow on the accelerator pedal. Roundabout is a tart so it's mostly moving off from a standstill too.
