What happens if you don't work your notice?

Another thing to consider is it could be possible that if you are not working your contracted notice period and just leaving they may be able to sue you for the cost of getting temporary staff to cover your work for the duration of your notice period to cover their costs as you are in breach of contact, (IANAL)

Our place you can normally negotiate down the notice period quite significantly ....
 
Im in the same position.

I started a job in November but then was offered a better job after my second week but cant start it till March. Now since I've just started the job I'm currently in I've not yet signed my contract. So do I have to work a notice period or could i just walk out?
 
I have already used all my holidays that I should have been allowed up to April this year.
You may have to pay that back. You accrue holidays for the time you work, if you finish before the end of the leave year they are entitled to take back what you owe in pay. Wether or not they choose to persue it is another thing.
 
I never signed a contract either but I think after a certain ammount of time they just say it counts as you did lol

But I'm not sure how long, I'd imagine you would be ok, but don't quote me on that.

Request that you pay back what you owe (holidays, claimed benefits, etc), possible employment tribunal, sue you for breach of contract, no/bad future reference...

There are a few things they can do if you really annoy them. If they choose to follow them up you could find yourself in hot water.

They would only do that stuff if it would cost them a lot of money if you went (i.e. super project critical and they have no cover for you) - else its a waste of time and they just will give you a rubbish references.

The only legal stuff I know about references is they cant give bad opinions of you - they can point out, as stated, you were late every day and left during the notice period etc.
 
The only way I can give full notice is if I hand in my notice at the same time as getting signed off for 4 weeks. But still go to my new job.

No, you are signed off from any work, not your current work. Working when signed off can do you more harm than good if you are unlucky.

Have you even approached them and asked if you can leave before your notice period?

As Muban has said, getting signed off sick and working is not the choice to make.
 
My notice period is 3 months - everyone seems to just work a months notice, in the past people have worked as little as a week. Best approach is to talk to them - if they have plenty of cover they might even let you go that day ;)
 
Have you tried just asking them if you can work a shorter notice? When I left my last job, I was supposed to work a minimum of 4 weeks, but I asked if I could cut it down because I really didn't want to be there any more and in the end I only did one more week.

I did this and got away with it 5 years ago. However I wouldn't recommend it. I was just lucky, it is very dishonest and could get you into trouble. Use only as a last resort.
