Right, this is a weird one on me now. Just before Christmas I tried to sell a pair of designer jean on Gumtree. The jean was new and all, selling it because I lost so much weight (dropped from waist 36 to 32 now).

After about a month, I received an e-mail from a company called FSPROTECTION UK (the person who send me this e-mail uses googlemail, apparently) and said how I am selling unauthorised duplications and asking me to remove the ad. An initial search into this company name got me nothing, nothing even came up in google. So I returned the e-mail, asking for more information regarding this matter, and questioned their authenticity.

Then today I got another e-mail from the same person saying how I am definitely selling replicated / counterfeit versions of the jean and how I broke the law, and they are obliged to commence legal action against me. They want me to send in the "proof of authenticity" to them as an attachment (for the e-mail) and valid business details within 3 days or they will commence legal proceedings.

Now this is the part where I am totall confused. I am a full time student, I can't provide any "details" when I don't even have any.

They don't really address my name in the e-mail I'd imagine that they don't really know who I am apart from the ad (which is now taken down by me already)

Has anyone had any similar experiences? I'm just so confused at the moment :confused:

I would ignore them tbh. Sounds like they're only trying to scare you - probably someone else selling jeans trying to bully competitors. You're selling a second hand pair of jeans for christ sake - I very much doubt they would be able to make anything of it. Tell them you want no further contact from them or you will contact the police about harassment

If you know they are authentic then I would just ignore tbh.

They dont know who you are and you have done nothing wrong.

Plus people sell knock offs all the time and dont get sued.

They're just after your details.

If it was really that bad then Gumtree would have took the post down themselves.

It's not actually a second hand but certainly it isn't fakes. Although I did purchase it off the net originally

ignore them I think or simply burn their house down and drown their goldfish :)

if you get anything through the post simply say that they are now sold and you dont have proof anymore.

Did you sell the jeans. Have you actually explained the jeans were as new and unused rather than you retailing the item.

They cannot just go to court and win and you owe them money...there are pre-action protocols to be used and one is not to give you 3 days to reply or for you to prove your innocence they have to prove you guilty.

If I were you I would ask for everything to be written down on paper(what they are accusing you of) and sent to you and then pop down to CAB.

Ignore them, you are not a trader, you are selling a pair of jeans that don't fit you anymore.

If you were a business and selling many pairs you could possibly be obliged to prove you are purchasing them from a genuine EU distributor.

But you ain't, and they're fishing, or given the google mail just prank calling.

I have explained everything in the ad, stating that the jean is brand new and unused. When I bought the jean myself a fancy certificate came along with the jean, stating how you've purchased the authentic product etc.

I just find it extremely weird how this person from FSPROTECTION kept on insisting that I actually am running a business underground producing counterfeits

Do not provide anything at all, ive seen this before when i did my law class.

Do NOT provide anything as it can easilly fall against you if you give them exactly what they are seeking, wait for the summons, then act on that.

Send them an email back telling them to send you proof of who they are first? There company number, what country they are registered, their company's register address and the details of the solictor who will be commencing legal action against you.

TBH i would send an email back with more than a few four letters words in
