What the ****ing hell are they playing at ?

I could be wrong but while the claim was under dispute and being subject to investigation wouldn't they normally take the stance that your NCB would be reduced and if it turned out you were in the right they would refund you the money ?

This is true, if you have an outstanding case/claim with your own insurer, regardless of fault, until it's resolved they will dock your ncb as if it was your fault. Happened to me, then when it was proved the other guy was at fault everything went back to normal :)

After losing my temper somewhat he tells me he was handed my case last week, he said he hasn't even looked at it and that it was stated i was 100% liable for all damages and the case has been closed!!
Sounds like it's all done and dusted in their eyes, so he has to fight now to get it reopened and sorted out properly..
 
well i had a bit of good news.
he rang me back and said that i had been liable due to lack of evidence to which i told him that due to you not doing your job correctly as you had all the informmation needed to contact everyone involved to get statements etc. He said some other crap and then said that he will change my policy to protected no claims so that i wont lose mine but i think i still get the fault on record so i'm gonna ring them again tomorrow as i need to speak to a different department about my renewal apparently.
Will the fault push the premium up much keeping in mind i have already ended the policy with them now? and will they need to send me a letter or something to prove i still have my NCB ?
 
Yes it probably will increase your premium. Sounds to me like they know they have done something wrong otherwise they wouldn't be offering you anything. Push it harder tomorrows and if there's no give then contact the ombudsman.
 
Go straight to the ombudsman to be honest. Norwich union have done domething similar to me in the past but I had just come out of court from an old bike incedent and really couldn't be bothered with it all and thus lost 4 years no claims. silly mistake now, as it has cost me more in the long run but I was never gauranteed anything anyway.

They just assumed I was completely liable with 0 investigation, just a phone call. I didn't even want to claim in the begining either, just to let them know it had happened. Insurance is like a lottery for me and I do try and get a decent insurer rather than a cheap insurer. Oh well!
I had exactly the same situation with Endsleigh following a dispute in which they assumed I was liabile with no investigation. Like yourself I didn't even want to claim and just phoned to let them know it had happened.

Time passed and I didn't even realise there had been a claim until I cancelled my policy and asked them for proof of my 5 years NCB. They then told me I only had 2 years as there had been a claim on my account. I couldn't believe it but after getting passed from person to person ended up giving up (mistake) and passing it off as an experiene learned.

Will never deal with them again though.
 
He knows they are in the wrong cus he has the file with all the details for the 3 people in my car and the one independant witness who pulled out of giving a statement, which is why i think he said he would protect my NCB as thats the main thing that was worrying me.
 
quick question as this still isnt sorted, can i request a copy of the case file from them so i can look over it myself or will they refuse such things ??

you *should* be able to get copies of everything they have about you on record under the data protection act....

i just can't see how im going to get it sorted 100% because its not like i can afford to take them to court and im still not sure 100% what the ombudsman does, i dunno if its just a complaint service or if they will help me sort it out :confused:. But it does seem like i'll be keeping my no claims but even a quick run through moneysupermarker insurance thing like confused i still cant get a quote under what im paying now :(
I've been without a car for a month now and it depressing me, even though i hate my car cus its a state, i still love it and want to drive it:D
