Hi all well im not having any luck here tbh I got a Wii for the kids and me hehe for chrimbo well its been playing up eg keeps freezing on me randomly well i only got it 5 days ago so im taking it back it has happend every day now.

some times it will work for 5 mins others hours and hours then it freezes i have no sd card in it so ain that and no other bits connected.

i spoke to the place i got it from and they said bring it all back and we will test it thing is i can hardly move with my back at the moment and i dont want to get there for them not be able to reproduce the error and say bugger off.

allso they said they may offer to fix it i want a new one i aint having to wait for it to be sent off etc its only 5 days old.

so i suppose im asking what are my rights here i cant be sure it will fault on them when they test it but i aint going home again with same console as it is faulty.

Take it back and demand a refund.. Not a test.. You are within your rights within 30days for a full refund.. You may get some jumped up idiot telling you otherwise, but do not take no for an answer.
 
realy? ok well i dont realy want a refund just a complete new wii i was told to bring the lot back well i would have settled for just a new wii console would have saved me packing and messing all my nice cabling job i did hehe.

so by rights i am entitled to a new wii not just a wii console i can demand a complete new package?.

they said they will test it so i hope they get the fault i do if not i hope they understand that i have tested every thing to make sure its not nothing silly dirty disc etc as i have tested it with 3 games now does same thing.

so law states within 30 days?.
 
real sorry to bump just that im hoping to take it back tomorrow and dont want to look like a noob if i start demanding this and that if they say i have to go away etc :).

i think they will be ok it starts with a G the place im going.i dont think they are competitors of ocuk but i wont type it any ways.
 
Just take it back and demand a new console. If they say no, Demand a full refund (don't take store credit.)

Once you have your refund just go to some other shop and buy one from there.

They should just change the console though tbh. Not like you are taking it back for money, Why would you lie and then ask for the exact same product?
 
I don't have the specific links on me (other than this UK Gov site: http://www.consumerdirect.gov.uk/), however as mentioned under UK Law you will be perfectly within your rights to demand a replacement or refund for the goods purchased. I imagine that the store may want to test something as a standard practice within their process to make sure they filter out user error/non-genuine returns.

Either way if you are fair but firm with a store, you shouldn't have a problem, however from time to time store managers/staff will be trained (or as the case may be, not trained) to avoid returning goods to help protect an individual stores margins and numbers and quote their own return policy which are irrelevent under UK Cusumer Law and the standard rights you have.

The other trick is that you can usually call the Customer Services number of a high street store off your mobile, which can in turn 'overrule' an individual store's decision and help you get the outcome you are looking for. This number will be on their website.
