What to do? Hit and run in car park...

Yep. Insurance is a joke.

It's not at all. While its a pain, it's entirely based on statistical data and not conjecture or opinions. It's a bummer but you're more likely to have another claim if you have a non fault claim. It is MUCH more fair that way than the way a lot of people think it should work

Do this:
1. Get a repair quote from where you want it repaired (I would suggest either Jaguar themselves or their approved repairer, as this will maintain your paintwork/bodywork warranty)
2. Tell them how much it will cost and offer them the choice of either paying in full themselves or going through their insurance
3. Depending upon the outcome of step 2 you either:
a) contact the police then go through their insurance
b) go through their insurance
c) get the full amount of the repair then have it repaired

It's pretty simple really.

No. Not if she's not making her own claim...

Having a fault claim against you and having a no claims bonus are two separate things. It's not a 'no blames bonus'.

But it will still be a claim against her. No claims bonus isn't just if you claim for yourself, it is also relevant for claims against you. Otherwise what would be the point in NCD with TPFT insurance?

Thanks all, apologies for hijacking the thread lol.

So it seems insurance is literally there for complete write-offs and so you don't get pulled for having no insurance as it is not worth the time or money for minor damage. I still don't get how if it not your fault you still get loaded. I get post code and theft etc but that just seems wrong.

Statistics say you are more likely to be accident prone from other people after you've had an accident that wasn't your fault? This is that protected no claims rubbish isn't it? Go back to having a claim and losing no claims - it will make people pay more attention to the road.

Because you can still claim for FT, which is you claiming, not a third party.

You need only watch the many 'not my fault but so determined to maintain being in the right that I'll plow into an avoidable accident anyway' that appear now everyone are getting dashcams to have an insight into why this is.

Other typical examples are things like insisting on parking close to the supermarket where all the kids bang their doors around and mum is distracted by them rather than at the back where it's empty. Parking opposite a T junction at the bottom of a hill in the snow (think that was someone here). Parking on a tight road with few passing places etc.

All things that might not be your fault but statistics show that the people making those sorts of claims, generally end up doing so again more often than others do it for the first time.

It's not correct. It's the excess she doesn't need to pay if she doesn't ckaim for her own damage. Her ncb is affected irrespective.

Sounds wrong to me. Otherwise why would people do anything they can to deny liability in cases like this?

I've only had one non fault claim when someone backed out of a parking spot into me, my insurance wasn't effected but that was back in 2005. In cases like this I would always pursue the insurance route even with the potential for extra costs as it avoids the mine field of "It's going to cost ££££" "Naaaaah mate, I was talking to Johnny down the pub and he said he'd sort it for a score."

I do find it very liberating driving a pre marked up company car and 19 year old tidy but far from perfect MX5. Which is a shame because I'm at a point where I could buy myself something nice now but I simply can't be bothered with the hassle.

Thanks for clarifying. That was my understanding too.

Call the police, it is a criminal offence to leave the scene of an accident. This is happening far to often these days and people need to start being punished.

Yes and no.

If it happened in a car park it's not a fail to stop and report. The Road Traffic Act for Stop/Report legislation applies to a road, which a car park is not.

A car park is not a road - Clarke v Kato [1998] 1 WLR 1647. However, it is a public place within S192 and so otherwise included.

However the Motor Vehicles (Compulsory Insurance) Regulations sets out obligations for involved parties to make known their insured status and the details of such. It includes Public Places which a Car Park will be. It could be seen as a civil issue rather than a criminal one though.

ASDA van reversed into mine on my drive, women driver got out, looked at car then drove off. My neighbour saw as she heard the crunch bit didn't get the plate.

Atleast you have something to chase!

I've had this twice and just ended up paying to have the car fixed, as the kind of filth that does this tends not to have £700 odd sat in their bank to pay for things like fixing accident damage they have caused to other people's cars.

The monedo was £680 something + vat in February from someone reversing into it in park and driving off, and before we got the monedo I had to stump a similar amount from someone taking the bumper off the mini doing a similar thing.

Ring their customer care line, it will be pretty easy for them to figure out what van / who the driver was. They will see what store covers your area and from there it can easily be narrowed down.

Call them, it happened to a neighbour here too. Didn't get the plate but called them and explained what happened, and sent them photos of the damage and they ended up paying for the damage/going through insurance
