Wheel Clamp Advice

Ok, last night I found my car had been clamped. I phoned the clampers and they wanted £141 to remove it. Plus they weren't going to come out last night to remove it. :mad:

So they agreed to remove it at 8am this morning. Anyhow after many phone calls it was 10am and they still hadn't arrived.

So, I thought I'd take a better look at the clamp. Fortunately beetles are pretty easy to work on, so I removed the ball joint and suspension and the clamp slipped right off. :p

So far I haven't contacted the clampers. (PS this is a 'private' clamping firm, not council. I would never consider doing this if it was).

They've tried calling me obviously not found me where they left me, but I havent replied yet. They've sent me a text saying they 'know where I live' and they're staking out the M2. Which is nowhere near where I live. :rolleyes:

The notice they left on my window has a PO box and address, so I'm going to send the clamp back 1st class recorded delivery to them, completely undamaged by being removed. However I feel I should should text them back to let them know.

Am I legally withing my rights to do this?
 
Erm, don't send the clamp back to them?

You're meant to remove it and take it with you.... anyway- what clamp? Etc... ;)
 
I'd imagine it was... but can't back this up. Hopefully someone will come along that will know the law side of these things :)
 
Sod them, ditch the clamp in the nearest canal or take it down the tip. I absolutely HATE clampers after being clamped in the university car park a few months back by the rent-a-cop-couldn't-make-it-in-life-so-turned-to-university-"police".

Fair play for removing it, I'd have done exactly the same and may even consider crapping in a bag and sending that to their P.O. box.
 
I'd send it back. As above - pretty sure its legal to remove if you can do it without damage, but if you keep it or dispose of it you might get in trouble... they usually take pictures of your car with the clamp on etc for proof.

Can they stop you from trying to take it off? I mean if you found your car clamped and they are there, could they obstruct you jacking your car up and taking it off?
 
Drop it in to your local cop shop and text them telling them where to collect it.

Pretty sure it isnt illegal to take it off. I'm guessing you were parked on private land (private car park)?
 
You should have left the clamp in the car park - if they wish to attach it to yoru car that's their business but they can't complain if you leave it lying there when you remove your car.

I guess you could say you left the clamp there - again, their own fault if somebody nicked it, they shouldn't have left it lying around the car park :)
