Where do I stand on this broken memory card?

I bought a memory card from Argos a couple of months ago using a voucher, it's a 16GB integral ultima pro card, when I put it into the card reader today it fell apart and can no longer be read, I can't see any obvious damage to the circuitry over than a slight bend in it.

There are obviously photos I just took today on that card that need to be recovered, obviously I am entitled to a replacement for this shoddy product, but what about data recovery?

The warranty will usually state that it's limited.

Kingston, for example, state this:

This limited warranty covers only repair, replacement, refund or credit for defective Kingston products, as provided above. Kingston is not liable for, and does not cover under warranty, any damages or losses of any kind whatsoever resulting from loss of, damage to or corruption of, content or data or any costs associated with determining the source of system problems or removing, servicing or installing Kingston products. This warranty excludes third party software, connected equipment or stored data. Kingston is therefore not liable for any losses or damage attributable to third party software, connected equipment or stored data. In the event of a claim, Kingston's sole obligation shall be to issue a refund or replacement of the hardware.

*sigh* Such dis-reputability doesn't surprise me unfortunately. Though this is not a warranty issue, but a sale of goods one, is it any different?

Completely fell apart?

Did the chip snap or just the clip part, is the metal chip part broken?

The casing came apart and the metal chip looks like it's bent to a degree, it just isn't recognised in the card reader at all now. :(

What i would try is bend the chip straight again, take the reader apart and try and just place the chip on the contacts, long shot but if you play around with it you may just get enough time to recover.

I'm worried that bending the chip could cause irrecoverable data loss, and have the retailer blame me for it's damage. I also don't want to break my card reader as well considering it's also my hub which I need for all my usb devices!
