Where do I stand on this?

A month ago I ordered and paid for something off fleebay but the supplier did not have the item in stock and I was given a full refund.

I then purchased a similar item from a high street store.

I’ve just received an email from a courier stating that they are delivering a package to me. It seems very likely that the cancelled transaction supplier is forwarding the item to me. Most likely a mistake in the store.

I don’t want the item, I haven’t authorised payment and after the acrimony I had with them, I’m NOT prepared to spend any time, effort or money trying to contact them. I’m certainly NOT prepared to take the item to the post office, nor pay to phone them.

If the courier, as couriers do, leave the package: in my doorway, behind my wheelie bin, with one of my neighbours etc whilst I'm at work and the supplier then realises that they have NOT been paid what action could they legally take against me?

Am I at liberty to give the items to a local charity shop? I certainly don't want them in my house?

Any advice would be appreciated
 
When it arrives contact them. Let them know they can collect it by appointment.

It isn't your responsibility to organise for it to be returned, either morally or in law.

Certainly if I'm home I'll refuse delivery, but quite often couriers leave items with (any) neighbours etc. I can hardly refuse to take hold of the package when it's being handed to me by a friendly neighbour. I'll then be stuck with a package which I don't want in my house. I'm gonna come clean now, it's not from Ann Summers, it's some fabric material.

Yes, I have proof of cancellation through fleebay. What can I do, legally with unsolicited mail?
 
If it arrives tell them they have to arrange to collect it, and obviously you're entitled to a refund. I wouldn't sweat it too much.

I don't quite think this is covered. Not the best source, however:

In the law of the United Kingdom unsolicited goods are goods delivered to an individual with a view to the individual acquiring them, but where the individual has no reasonable cause to believe that they were delivered for legitimate business and had not previously agreed to acquire them.

In this case, you ordered the item, but later cancelled and got a refund. This suggests that what you're now receiving has been sent by mistake, rather than being unsolicited goods as defined legally. When it arrives, confirm what it is and then advise the seller that they can collect it at their expense and at your convenience.

I had a better site which explained the law clearly a while back, but can't find it now. :/
 
I'm NOT sure what is meant by dropped shipping deal.

I ordered and paid (paypall) for the fabric but was charged for two courier charges. I immediately contacted them (Sunday) stating that as they would be putting the items in the same consignment I felt it was only proper that they reinburse me with one courier charge. I didn't hear from them until the Tue when they sent me an email saying the goods had been despatched.

Half an hour later they sent me an email saying they could not refund the courier charge because the items had already been despatched.

I responded that if the items were received in two separate packages that would be OK, if NOT I felt they were being unfair.

An hour later I got a phone call from the storekeeper saying that he was unable to meet the order because they were out of stock. Good Hey, especially as they had already stated that the items had been despatched. The storeman said that he would give me a full refund. The case was closed through Ebay.

I left them negative feedback and I'm certainly NOT prepared to phone them, unless they are on an 0800 number!

Thanx, the six month rule seems best, then I'll pass them to a charity shop
 
Just get in touch with them via email at least

I ordered a digital camera from Japan on ebay before (brand new). Didn't turn up after 3 weeks, so I got in touch with them and they sent out another

In the following few days I received two packages, both cameras turned up! :eek:

I emailed them asking for their address, they simply replied "just keep it, thank you for your order"



Sold the camera and bought a PSP with the money :D
 
The goods are not unsolicited, lets get that out of the way.

Legally I believe you need to inform the seller giving them reasonable time to collect the goods before you can do as you please with them.

Drop shipping is where I sell you something, but then I get my supplier to send it directly to you, rather than having it myself and sending it on to you.

It's common with electrical items that come straight from the Far East... Not so sure about fabrics.

The reason I ask is that the process is that bit more removed from the seller, so there's more scope for things getting mixed up, stuff getting sent without being paid for, vice versa, etc.
