Where do i stand??

Little question i could do with clearing up if anyone knows the answer.

Put my PS3 on ebay also added a buy it now price
Which some guy used and won the item.
Now i then get a call saying can i come and pick it up?? my reply was yeh sure no worries i wont be here but someone will.
Later on i get a call from my dad saying the guy is here but he paid using paypal.
So my brother logs into my paypal and sure enough a payment has gone in
Obviously me not there says yeh let him have it
This was sunday night
Now then get home from work last night to see the payment has been held due to someone unauthorised had used the account
Now tonight they have reversed the payment back to the account
So im now without the money and my PS3

Phoned paypal and basically there saying my fault
1. i should never let them collect
2. Never send it to an unconfirmed address

So im really not happy but i just wanna know where i stand ??

Do you have his address?

I have people collecting stuff from me all the time but id certainly be there when they came and only accept cash.

There is an address on the paypal account invoice thing but im unsure whether its the guy who bought it or not
 
Have emailed the buyer on two different addy's i have
No proof as t owho he was
Last resort would be going to bolton where the address i have is takin my younger brother with me as he was there and knockin on the door
See if he can identify the guy then take it from there

I have mailed Ebay tonight so i shall await the response
 
You got scammed... nothing you can do unless you know some info about the guy who picked it up ( like a car reg number ) even than there isnt much you can do even then. Its possible he is the actual owner of the account and is trying to pull a fast one with paypal. Maybe goto the house thats registered and see if its him who answers the door? if it is then contact ebay/paypal and inform them of the fraud. ( not that i expect they will care anyway ).

This is exactly what has happened.

The guy has bought the PS3 on Buy It Now and paid the money over PayPal. Before the PS3 was shipped he's said he'll pick it up, taken it home and then emailed PayPal saying "someone got into my account and ordered a PS3, I've arranged with the seller not to deliver it and I'd like the money transferred back to me."

PayPal pretty much always side with the buyer, and in this situation all the seller needs to do is provide PayPal with a receipt from Royal Mail or the courier. This is what the scammer was counting on, as he's already picked it up himself so there is no written proof of delivery.

As far as PayPal can see it's just a case of the seller not sending the goods, or specifically in this situation a case of the delivery being mutually cancelled by both the seller and buyer. Ebay and PayPal won't give him any money back without proof of delivery, they might even just think he's trying to scam the scammer ("I delivered but haven't been paid" scam).
 
Right i have a phone number here i think its a payphone is there anywhere i can input this number o see which payphone it is??
Maybe if its close to the address it will give me more of an idea

Maybe im just clutching at straws but im not a happy chappy at present lol
 
do you have the PS3 S/N?
If so then you've got a chance, reporting to police etc if you go stake out the address and it is infact the guy.
 
what kind of feeback rating does he have and how long has he been a member of the site?
 
Pay a visit to the police station. They should give you a crime number and you can claim it on the insurance, or if you can be bothered ring sony and ask for the last IP that connected. Probably won't give you it but technically that could be used to find the location of the PS3 now.
