Where do I stand?

Whilst I was moving another agency turned up to try and move their client in producing a contract. There is a lot of arguments, the police were called and now all the agencies have left.

I am stuck in the room with the landlord and the other tenant. The landlord says she never signed an agreement with my agency. My agency are yet to provide a hard copy of my tenancy agreement and I don't have one on me either.

What do I do?

Well what you shouldn't do is take it out on the other tenant/agent tbh... especially as they have a contract and you seem to have handed over a bunch of cash without having one...

Seems like you've been a victim of a scam? Or there has been some misunderstanding... I'd move your stuff out of there and take it up with the police and with the agent you dealt with.

Does seem odd that you've presumably got a set of keys for the property yet the landlady claims not to have contact with the agency?

Sounds like landlord has given instruction to agency then has found their own tennant via another agency. Your agency have not followed proper protocol in speaking to landlord and have just gone ahead issuing a contract to you.

If the landlord has signed an instruction for the agency to not need to validate an agreement then the likelyhood is whoever signed the letting contract first would be the holder of the valid lease. It all depends on the agency to be honest they may well have been acting within authority and the landlord has not advised them he planned to withdraw their agency (they are an agent for him)

I am in a massive pickle here and in I will name and shame as well once it is sorted.

I have signed a tenancy agreement with an agency and moved in today. I paid my deposit, agency fees and first months rent.

Good luck in getting it sorted :)

You and the landlord file for fraud.

Hate to say this but it sounds like you have fallen for one of those scams where someone rents a property out they have no real access to just to take the deposit and run.

The only problem is -

the police were called and now all the agencies have left.

They must have a massive set of balls to do it in front of the police.

Think it's obvious that I need to be sueing someone to get my money back, don't know who to start with.....the whole thing is a bit fishy.

Anyone dealt with a no win no fee service they can recommend?

Can anyone link me to some information on what constitutes a legally binding contract? Because I've just realised all they have from me is a photocopied tenancy agreement with my signature on it and not the landlords, surely the fact they only have a photocopy of my signature means nothing!

My agency deal with several tenants in the let who have had contracts for months....I think the agency has been around a while
