If a car has to go over a path to park up in a shop or drive way who has right away?. The other day I was walking on a path and cars who wanted to park up to get to car park had to go over foot path. It was similar to a drive way on a pavement as there where no junction for the cars to go down. So who has right away on paths if there there is no proper junction type thing for cars?. The person just nodded at me to say look when I think it should be them as they got to cross the path.

Pedestrians always have right of way, even on roads.

Right of way precedence is pedestrians > horses > animal drawn carriages > cyclists > motorised vehicles.

Obviously, don't rely on that stopping you getting hit though - you're a bag of meat and bones and the other is a two ton steel cage - no bets taken on who will come out of a confronttaion better.

The pedestrian in this case has right of way.

Though if a car was coming at me over a pavement I would indeed get right away.

Pedestrian would have right of way but personally I'd prefer not to argue with a car. It didn't work out for me too well last time :D.

But no one has right away though.

I always get funny looks when I continue to walk on situation like this. Its quite funny. I just wanted to make sure if I was in right as if anything did happen then it be the driver.

It's the same when I'm walking to get the kids from school and the parents are parking in the car park beside the school. I've ended up sat on the bonnet of cars a couple of times :-)

You might be "right", however you'd still be in hospital/dead.

Whilst I agree with you in principle, there are some battles you unfortunately can't win :(

Of course it would unfortunate if the metal tip of your umbrella was sticking out when the car bullied it's way past ;)

Well just hope you're around to claim. Although you've got the right of way it's safer to assume they want to kill you and let them pass.

I'd stop to wait for the car to pass, regardless of whether I have right of way. I'm more concerned about causing a queue on the road or being hit by someone that is frustrated and distracted than I am stubborn about exercising my right of way :p
