My friends car was hit by another car while being parked.

My friends car was parked illegally on the sidewalk and most likely the other car drove backwards against the door while leaving his/her parking spot.

My thoughts are that while my friend was parked illegally she will lose or at most it will be 50/50 but she maintains that it doesn't matter where she was parked, he hit her car while driving backwards.

But what is the most likely outcome

To frankly saying my opinion.. Parking illegally mean that he is giving chance to others to hit. I can't support correctly because wrong is on both sides.

you're friend is obviously in the wrong in general terms but in the specifics of the accident I'm not sure it's relevant, could she have been validly sat in the car with the engine off, or could a disabled car have been parked there, i.e. was it double yellows?

As far as i'm aware, just because a car is illegally parked, it doesn't give you the right to smash into it. 100% other drivers fault, just because a car doesn't normally park there, doesn't mean there never will be one. What happens if someone breaks down there?

it can be parked anywhere, it doesnt matter. the other driver was negligent, they didnt observe the parked/stationary car, so it was their fault for driving into it

as has been said... illegal parking (or whatever) doesnt entitle you to drive into other peoples cars

She told me she doesn't know who hit her car as it happened at night/evening.

But she will start asking neighbours and look for damaged rearends of the cars in the street.

I told her to give the insurance company a ring to ask what she can do.
