who is responsable for rma?

Hi all I have a problem with my 5970 card.

am using it with 3 monitors and all was fine for 18 months then the signal from the mini disport has gone. done the usual swapped monitors and changed location on motherboard no good.

who is responable for the RMA the company i bought it from(not ocuk)say that the card is over 1 years old and XFX are.
XFX say on their web site "XFX does not sell its Product directly to the consumer therefore the warranty for XFX Products remains the responsibility of your reseller where you purchased the Product."
of course this card was over £400 so i would like it fixed.

Having been through this before with XFX and a company that sounds a lot like scam, you will end up back and forth, eventually the company you bought it from will cave and agree to take the rma, then they will pretend to rma it to XFX but what they will really do is offer you a cash refund of around 1/2 to 2/3 the price you paid for the card and they will state that its in their terms and conditions to do so and you won't have a leg to stand on and you will take the cash and not deal with either XFX or the company you bought the card from again.
 
I had an XFX GTX280XT that was over 18 months old, XFX said they couldn't fix or replace it but they offered my x amount off another product.

it depends on the warranty terms that the company in question has with their reseller.

First and foremost it's a manufacturer warranty so the manufacturer should never refuse to repair/replace/refund (partial value) your card if the reseller won't help. You may be required to cover some postage costs but they can't refuse to help you.

The reseller is obliged to handle the first year of the warranty. Some manufacturers, ourselves included, ask the reseller to handle the full term of the warranty but we don't turn away any end user who can't get reseller support.

With regards to Biffa's experience (I ran OcUK's supplier returns department for a while so I've had plenty of experience of this). Some manufacturers, if they can't replace or repair the card will give a "market value" refund to the reseller and there is nothing that the reseller can do to argue, the manufacturer in question were always one of those.

The SOGA states that the supplier can refuse to replace or repair a faulty product if it is "disproportionately expensive" to do so, in which case they only need to offer a partial refund if the user received some benefit from the product (i.e. it worked for a while). It sucks when this happens which is why the better manufacturers try to offer replacement or upgrade wherever possible.
