Wiping with no traces?

Unless 3DS Max has some kind of recovery program which it runs at install, then it's not checking that hard drive for an existing copy. Formatting the drive means anything on it is not visible to the OS you install on the drive. Yes it's still there, but as far as the OS knows, you have a blank drive.

If you insist on wiping the thing though, use DBAN.

From what you say though it sounds like you go and format your drive, install Windows, and then still have MS Office in your Program Files, which can't happen.

How exactly are you formatting your drive? I'm curious how "many progs manage to leave traces somewhere that last" - what sort of traces do you mean?

I'm sure I once read about some DRM software writing outside the usual partition structure to avoid deletion.

Having a search I could only find mention of TurboTax employing this technique and that was on Win98. (using Macrovision SafeCast)

Can't find any mention of 3d studio but if it is a low level format will remove any data sneakily sequestered in unusual places.
