Hi guys wont bore you with the details but ive been off work for around a week and a half now, ive been for an MRI scan and have an appointment at the fracture clinic next week.

If they brace my knee up and i can walk around okay i will be returning to week the following week.

However if its painful to walk around in a job where im constantly on my feet and would perhaps injure myself further I wont be.

I have a holiday booked for two weeks time, its all paid for.

Where do i stand legally with my holiday and work, would i still be expected to go or would work be annoyed if i go since i cant work?

I think you are caught between a rock and a hard place on this one. When people are off ill and immediately go on holiday - especially if they have a physical injury, 'general' work colleagues always assume you are being slippery.

All you can do is ignore it, go on holiday and let your mates at work know the real situation. A few photos of you immobilised on a sun lounger on facebook wont go amiss. :D

Massive difference from feeling a bit under the weather, to having a knee brace, MRI etc. . . . :p

You are obliged to inform your employer that you are going on holiday, you have to measure up the amount of walking etc you would be doing whilst on hols and consider if it would be more, less or equal than if you were at work. If the answer is more or equal, then you have to ask yourself if you are fit for work, your line manager will probably be thinking the same thing.

a lot less walking, im a bar man/waiter.

If your work are unhappy about you going on holiday when you are ill, then personally I wouldn't like to work for them.

I would go in and speak to them direct, best option.

I'm confused why your work wouldn't of let you go on holiday, you'd be off on sick pay if you stayed at home, or if you go on holiday your using your holiday time and they arnt paying you sick pay, it's in their interest for you to go on holiday so you get well in your own time and not theres.

If you are on the sick, holidays should automativally be cancelled!

you are right in the sence that is you are sick while you are on leave from work you dont have to take the holiday.. (people do it where I work all the time)

I doubt there is anythign stopping you taking the holiday time as sick and still going on holiday...
