Work Problem

I started working for company X in november 2004 (along with another guy) and worked 37 hours per week. Around May 2005 we were told that one of us was going to be make redundent and the job description was also changing a bit (40 hours per a week and having to be a first aider.) We were told that we would get a new contract when this new job description came into effect in Septembet 2005.

Anyway I got the job and since September 2005 have been doing 40 hours per week. I never did get a new contract though. I did keep asking an was told that it was being sorted and that I would get it soon. After a while I just forgot all about it.

Anyway it turns out that the contract never was changed and I haven't ever been paid for the extra 3 hours per week I have been doing.

Anyway as I fould this out today I was told that I would not be paid for all those extra hours I've done and have now gone back to working 37 hours per week.

So do I have any legal right to get the extra money or is it lost?

Yes, I think so.

Gather up all the correspondence you have regarding what happened between May and September. Along with your time-sheet or any evidence at all that shows you worked the hours they asked.

Tell them they owe you it, or you'll begin legal action. After seeing your evidence, they'll settle it I would imagine.

My supervisor (who this also affects) says he has to fill in time sheets for the hours I works each week. I'm not sure if he does or not but I should be able to prove it somehow.

And yes I am a member of a union. Would it be worth contacting them?
