Working/Not Working your Notice....

I find myself in the situation where by I have been offered a new job but unfortunately the start date for the training takes place on the 5th of April and I will obviously have to hand my notice in at my current job tomorrow.

There is a designated notice period of 2 to 4 weeks dependant on contract, length of employment etc. It is simply a retail job I have at the moment and boss who kept telling me, "if you get a job for your career and your off then so be it", however I have a feeling he won't accept my notice as he is of course entitled not to.

This leaves me in an extremely awkward situation as if my notice period is rejected which I suspect it will be where do I stand? Of course I would love a reference etc from my employer however I suspect that would be withheld and are there any legal ramifications with this?

Anyone who has been through similar experiences please share :)
 
Very unlikely you're current employer will do anything other than possibly hold back x weeks pay that you were due to work. I doubt they'd even do that it you talked to them and apologised. Most employment contracts are pretty hard to enforce.

Edit - meant to say, was a long time ago but when I was offered a job I walked out from the shop I was working in within the hour of recieving the phone call. The boss was OK with it though as she knew I'd been looking and didn't expect me to stay on, it was originally a weekend job after college.

That's the thing, my boss also knows I'm on the hunt and gave me the time off to attend the interview. I will no doubt ask him to waive my notice period and apologise for the lack of notice, I was originally only weekend staff for him and haven't signed a new contract since my first.

Hopefully it should all go ok :)
 
It's a bit rubbish from your boss' perspective.
As you say, it's only a retail job and I'm sure he would have been prepared for you leaving.

The best thing you can do (and tell him this) is that you let him know as soon as possible.

I don't see why he would withhold your notice period, especially if he's previously acknowledged your job search. Empathise with him but be firm.
 
Been there before, I just didnt turn up for the old job ever again. Didn't get paid for the month, however 1 month wage for a much better career was worth it :)
 
Rodga you numbskull, you know my new job is in Employment Law, why not ask me :D

Check your contract for specific comment on notice periods. If you do not have a contract, have not agreed a notice period verbally or have not been given access to a staff handbook, then your notice period is based on the statutory minimums - which depends on length of service.

My advice is to speak to your boss. Explain your position and tell him you want to leave, apologise for the inconvenience and tell him you loved working there but couldn't turn down this opportunity. Notice periods can be waived by agreement in most cases.
