Working Rights?

raise a grievance with your employer stating the working time directive and if they a) dont bother to answer or b) tell you to do one, you can take them to employment tribunal after 28 days of submitting your grievance in writing. It doesnt cost you anything and even if you fill a tribunal request and dont follow through they will drop a brick and give you your breaks

P.S join your union and get them involved, if its shop work its probably USDAW, if not ask around, they love this kinda thing, Im a union official for the POA (prison officers association) and we have reps in every workplace for our members
 
i'd say it may be a good idea to keep a diary of events and grievances as well as this may support a claim against your employer/manager, i'm not basing this on anything specific I just reckon it would be a prudent action in terms of gathering supporting evidence
 
Yes definitely document for a month or two so you can produce hard evidence. After giving your 'evidence' the once over they're more likely to act in your favour.
 
Loads of us where i work do 4hours shifts but are told we get NO break. This is fine, but most people go out for 10minutes to have a fag, yet us non smokers get nothing. :mad:

it's the same here, 4 hour overtime shifts or part time shifts do not get a break, we just end up using our ten minutes of "comfort break" for smokes this does mean we don't get toilet breaks whereas the non smokers do. The price you pay I guess!

I dont get any kind of break, even if i pop up for a drink of water (which takes 30 seconds) i get told to get out if seen, while the smokers are sitting on their arse in the fag hut :o
 
I would leave it tbh, They will give you an unpaid break, I would rather have that time at home than at work unpaid.

All though you should tell them to get lost when they tell you off for taking a drink or a 5min brake.
 
what the others have said, document it for a month or so, take it over your bosses head and talk to HR if there is one.

I believe that you can only work for 4 hours max with out a break.

pretty certain it's just 4

the reason being that the reason our 6-10 staff don't get a break is that you have to work >4 hours to qualify for a break and they work 4 on the dot and hence don't get one, if this was 6 that makes our break policy wrong, which considering my companies attention to detail in other areas, makes that highly unlikely to be true.
 
it's something like 4hours for a 15min break and over 6hours is 30min brake, but that 30min brake does not have to be paid. Which is why you have to be careful and decide if you want to spend an extra 30mins at work unpaid.
 
I went through the document at my work and it states...
0-4hrs = 0unpaid break and 0 paid break
4-6hrs = 0unpaid break 15mins paid break
6-8hrs = 0unpaid break 30mins paid break
8hrs+ = (ill upate this when i check the pic)

Rights? You don't have any unless you've been there 3 months (with the exception of any contract you signed). A tribunal isn't going to do anything for you otherwise.

As stated above, breaks at work do not have to be paid.
