All of the writers are liable. Only thing that pops to my mind is, not very Christian of him.... Haven't heard his song to compare and don't plan on it....

To be fair the hook is identical and it's not exactly hard to hear his song and thus give a input based on evidence rather than guessing... they are both on the page.
 
What are they going to do throw them all in jail? the profits from Dark Horse will have far outstripped any fine. Crime pays these days.

It's similar at best with it being in a different key and tempo. But it's a big problem if judges are ruling in favour due to similarity as there's hundreds of thousands of pieces of music that could be argued that they sound similar - 'Stairway to Heaven' vs 'Taurus' by Spirit court case is a good example of this.

I suspect it all centres around this hook in the Flame track, http://www.infinitelooper.com/?v=QCcW-guAs_s&p=n#/1;7, and the synth used within the verses of the Katy Perry track, http://www.infinitelooper.com/?v=vNb1PXWQHbo&p=n#/17;30 - you'd be hard pushed to say they're both exact, identical and a complete copy from one to the other.
Personally, there's too many (technical) differences between the two to say anything other than it sounds similar.

You're talking about the "Ya'll know what it is" in the Katy Perry track versus "You know what it is" in the Flame track? That isn't exact; similar sure but not identical.

But to include lyrics would be a humongous can of worms as you could easily pick a few handfuls of (lyrical) music tracks and find similar, if not exact, lines between them.
 
The argument here isn't that they sound similar - we know they do, that's why it went to court in the first place so arguing that is pointless - the argument it is whether Flame's work was plagiarized and the court ruled it was. "Similar at best"..nope, no sorry - I can only laugh at that.
 
Reminds me of Ray Parker J.R ripping off the Huey Lewis song "i want a new drug" to come up with the Ghostbusters theme.
