Worth arguing PCN? - not fully in bay

Hi guys

I've got a PCN for not being parked correctly in a bay. In my defence there was no charging enforceable at the time (charging not in place at this particular location from 6pm - 8.30am)... it was dark and the bays were not that clear and I was also squeezing into the bay as there was a van also overhanging when I arrived.

I knew I was over slightly whilst parking but given the above did not really see it as an issue..

It's only £25 but just seems a bit petty, - I could understand if it was the middle of the day and there was lots of transient people thus losing them money but given everyone was parked up for the night then it's a bit infuriating :p

Seems pretty careless and avoidable in my opinion. You aren't slightly over, you are taking up 2 spaces. It means that someone else can't park in the other bay or every other car will also be fined if they park in the same way.
 
If it is the council, pay it. They are quite strict around here about staying within the bay, often with plenty of signs to remind you.
 
Even though there were no enforceable charges at the time?

Funnily enough it was my mate in the bay in front of my car and he managed to fit in it fine. It was the fact that there was a van behind me when I parked up originally that forced me so far forward.

If that's how good you park, your driving skills must be poor.

Back on subject.
As stated if its a council Car park pay up as you WILL lose.
If its private bin it.
 
Can try argue it but then you will have to pay £50+ random other fee's.

£25 is not the end of the world.

Even free carparks normally ask you to stay within in the bay or face charges.
 
Has no one read the op, there was a van previously parked that caused him to park like this ?
Other than being outside of the bay he is parked straight.
 
My driving skills aren't the best :p

However in my defence when I parked up there was a van in the bay behind my car that was also overhanging. He must have moved before me this morning, although the van would have been there when I got the PCN as it was given at 8pm last night.. and the guy in the van seemed to be staying in the same hotel.

I'll just pay it at least it pays an attendants wage and keeps our streets nice and uniformed.

At the time there was also a van overhanging which probably didn't help. Sure, now it's empty it looks clear, however, I'd have probably moved the car back in the morning to avoid the fine.

If you couldn't fit in the bay owing to other vehicles at the time then yes I'd argue the case, they will probably respond with "you should have moved when the space was clear..." Or something equally helpful. Also if it was outside of enforcement hours then they have no leg to stand on surely?

That's what I'm trying to understand... the machine said 'Charging Hours' - ... so maybe you still need to comply with the bay marking even when the charging hours do not apply.

I will probably ask them for a photo, because it was issued at night so the van would have still been there (I guess he only moved it in the morning after leaving the hotel)

that's lamee :( you are a bit out of the space though and I imagine that even out of hours requires bay discipline (doesn't make sense for it not to apply....).

I would deffo try to dispute it with the argument that you were forced to park like that due to the van and if they have a pic of you parked and would have repositioned had you know the van had left (but that could have been at any time during the night/morning).
 
It's not the OP's fault so don't know why people are mocking his parking skills. If the van was overhanging from it's bay then obviously you need to shuffle up too to get in, thereby making every bay out of sync.

Your problem is you can't prove the van was there, as presumably you got the PCN after the van had left, otherwise the issuer is a moron.
 
If your mate could squeeze into the bay infront of you, could he not have parked in the bay that you 'attempted' to park in and then you would have had a full bay to yourself infront of your mate? Or was your mate hanging outside of the bay as well?

Crafty beggers say they'll get back to me in 14 days. So I still have to pay now.
