Would I be arrested?

Hi mate, it's good to know you would have helped me out :)

Yeah, if you had done something big, like knocked one of them out or something, you'd probably get charged with assault.

I'm not angry that no one intervened when they were hitting me. Because people were telling them to stop it, and trying to help me out like that. But I'm annoyed that the smallest guy in the cinema had to tell them to pack it in

Hi mate, the fact that your lil bro was there made me angry, kids shouldnt have to go through things like this, its not on. Having 2 young lads myself, I fear for their safety when they get older. Hope the little guy is ok.

It all depends if cps can show you used excess force, in the uk you can quite legally use a lot of force to defend yourself. However once some one starts running of you are not being attacked and as such can not use force against them. This is wheremost people fall foul of the law.

But here's my confusion, could I use reasonable force to defend somebody else?
Like I said, I guess it all depends on the circumstances I suppose.

I would imagine you would be arrested, the police would be sympathetic but the cps would probably prosecute you, whilst they will get legal aid you won't, you will then be probably given a custodial sentence of about 5 years, after 1 year inside the real criminals will go on to mug/kill/rape a granny/father of 2/oap, go to court, again with legal aid where it will be discovered that they had a hard time whilst growing up and sent to Barbados for 9 weeks worth of social correction whilst the council organises a house for them on their return.

Whilst all this is happening your still being bum assaulted by mr big who is in with the wardens.

As I said in my previous thread: they didn't do it hard. tbh, I think they were more pussy than I was, and that's saying something!

I think that they were angry because I said "shut up" and not "be quiet please". I can't remember, but I think one of them told me that.

Hmm, but looking back, couldn't you have just walked away with the kid, or something like that, rather than starting to detain Joe Public? I can see why you got into a spot of bother, after the description there (not that I agree with it, personally!).

Nope. Three 20 somethings kicking seven bells out of a 15 year old kid on lying on the floor?

I attempted to defuse the situation first obviously. They continued with their beating so I pulled one off, the other took a swing at me so I grabbed his arm and put him on the floor face down, with this the first ran off and the other tried to punch me so he joined the second, face down on the grass until the police arrived.

The boy was taken to the hospital by ambulance which arrived before the police btw, and he spent several days in hospital.

At no time did the Police not know who I was (I gave my ID as soon as they arrived, and they were well aware of the situation as there were witnesses, including the Doctor on the Ambulance (the witness I mentioned previous)

And the moral of the story: Toe-poke the primary offender in the love spuds, without warning and without saying a word (Except for the obligatory "You're welcome citizen!" to the bemused victim you've just saved from a kicking of course.) and preferably from behind. Then make like a shepherd post-haste i.e. "GET THE FLOCK OUT OF THERE!" while the now felled villain yucks up his din-dins from a surge of nauseatingly agonizing testicular pain and you make good your escape before the Po-po arrive.

Would you do the same thing again?

Personally I'd question the integrity of someone who thought "hang on I might get in trouble if I help out here" and used that as a reason not to help someone who was being attacked. Ultimately it just depends upon how much you value standing up for what you believe in, I believe that helping someone who was being beaten up by a group is the right thing to do, if the CPS think otherwise then they can prosecute away.

That seems weird, considering the lad needed medical attention :\.

To be fair the local policeman who arrived first made no issue whatsoever and he asked me if I would go to the station to make a statement. It wasn't until I got to the station that I was arrested, by two other policemen on suspicion of assault.

I got a lovely thankyou in writing from the boys parents and I still have it. I understand it can be difficult for police to assertain a situation on the fly, but my experience was pretty horrendous given the circumstances.

In the end the boy was fine, two of the three attackers were caught and punished (sort of) and I wasn't charged at all, but I can see why people do not get involved and maybe if the law wasn't such as ass, then public responsibility would be greater and the country a little safer.

You would be arrested, you may not be prosecuted. (as long as you used reasonable force to protect yourself and others)

Remember arrested doesn't mean charged charged

you could do but i doubt it. it would take a lot of pressure from the lads scummy mums and i cant see them bothering

the police arent 'all' heartless good for nothings

infact i think youd be unlucky if anyone even called the police. and even unluckier for a witness to side with the thugs.

I once stepped in on some guys harrassing a girl. I have some boxing and muay thai training so I figured if a couple of drunks got too angry, I could handle myself. I approached the guys, but they were clearly in no mood to talk, and, well, attacked. I threw one punch, a guy went down and the rest of them backed off. Fair enough. I didn't punch with full force, but landed a good one so the guy was out. I don't think I broke anything, and even did my best to catch him so he wouldn't fall head first. And then I spent 14 days in jail.

Unfortunately, today it's better to not step in unless you don't mind suffering for it for a bit.

You are platinum and i claim my £5 ;)

I think it's all down to one's morality tbh :o

If that was happening to someone close to you, you wouldn't exactly just stand there and think that you might get in trouble...

Anyways, my best mate knocked a guy out for harrassing his gf and the guy got sent to hospital... after the event, people called the police as the guy had a broken arm and really badly damaged face.... he got arrested and got questioned, but never got charged... And the Police themselves said that they would back him up in court themselves as they think he did the right thing.
