Girlfriend lives on a road with crap parking due to having no drive etc so finding somewhere to park is generally a Pain.

For a few weeks there has been a 3 series BMW parked right outside the house, it stays where it is for days upon end goes for a couple of hours then it's back for a few more days.

Her mum took the diplomatic approach kindly asking that him not to park there as it would be nice to park somewhere near her own house not 100 yards down the road.

Out of curiosity I checked the reg and found that the MOT expired in August and reported it to police 101 who have said it will be recovered

Would you have done the same?

No, until the last sentence. Then yes, if it was really annoying. Like having to walk 500m to my car annoying.

But now maybe they suspect it was your gf's mum. Check letterbox for poo.

Ultimately, they're free to park where they like. Neither your gf nor her mum own the street.

If my mum asked someone politely to park somewhere else and they blatantly ignored her request I'd happily report them, and then stick an a4 troll face and put it under the windscreen wipers :D

I understand they're free to park where they like, they pay VED like the rest of us etc. Had it have had a valid MOT then it's something I/they would have had to live with.

Her mum isn't bothered about the issues it may cause and I've told them that if he does question it then feel free to give him my details as it was me that did it.

Aye report em, no MOT so technically no insurance AFAIK

However that's the sole reason, its a public highway they can park where they want, even if it is outside your house as long as they don't block your drive. Much to many peoples annoyance.

The most annoyed I've ever got about this was last winter.
snow was bad and our streets don't get gritted, there was me some old guy from a bit further down spreading grit and clearing snow, not one other person helped. cleared a spot outside my house so I could park and move off in safety come the morning. got up dropped the missus off at work, got back and there was some massive 4x4 parked slap band in the spot I had cleared, I must've been gone all of 20mins. and this was for days in a row!

 Thanks for your invaluable input :)

My insurer said I NEEDED an MOT *shrug*

EDIT:
Just having a read about aparantly it's not cut and dry and is down to wording in the respective insurers T&C's

So if that "annoying parking person" has "A valid MOT is needed for Insurance" in their T&C's they yes they are uninsured.

Still, if they're so easily letting their car MOT be 3-4 months overdue, then who's to say they haven't done the same with their insurance anyway

.But I'm going by what my insurer told me

As long as the car has insurance then it is insured to the legal standard to satisfy the law (third party cover) - It even has to state words to this effect on the policy certificate.
Any other problems such as no MOT, undisclosed modifications affect the policy holder right to claim for their losses and may also leave them open to recovery of third party losses if they were very negligent.
