Wrote car off.

Well thats it, should I have stopped and possibly had another car go back into me, I dont know, could she of stopped of stopped somewhere else and less dangerous? lots of other places to stop.

I have seen this far too many times in similar situations to expect anything other than a negative outcome for the OP, CCTV footage, witnesses the lot.

Seems to make not a jot of difference in my experience.
 
Sounds like your fault. He car failed, she pulled to the inside, you saw this yet maintained your original speed and course even though your visibility began to be seriously reduced. Then you crashed because you were not travelling at such a speed that you could stop in the distance you can see to be clear.
 
Ive wrote several times i reduced my speed. If I went into the back of her at 60mph I dont think id be here to tell you about it. She was in a 4x4 i was in a considerably smaller car.

Yes. In the insurers eyes the person who crashes into the back of a car is at fault. You should be able to stop in the distance you can see, if not you are going too fast.

I couldnt actually see anything at all infront of me apart from smoke, I started to break asap and about 2 seconds later I went into the back of her. Anyhow thansk for the input, will post tomorow to say how thing went with insurers on the phone.

It depends really. I've had a similar thing happen to me (lorry lost a tyre in front of me and visibility went to hell, as I posted in the Stobart lorry blowout thread) and I was as worried about someone behind me not being able to see and failing to slow and hitting me. While that would arguably have been the fault of the driver behind, I was more concerned with maintaining some mobility and slowing gently, just in case.

If it's a fault with her car, then I wonder whether the insurance company mightn't blame her or pass it on to the manufacturer or whoever most recently serviced or MOT'd the car.

unfortunately this is largely true

You are relying upon her to be honest and admit fault. If she doesnt, and she lies, then your up **** creek without CCTV or an independent witness.

And £5 says even if she does intend to admit fault, she won't once she gets home to her husband.
 
My insurance have got an investigator on the "Case", sounds more like a murder not a car crash hah! She has infact denied liability. Surprise

I told her what happened and that the woman said to the policeman about her not feeling in control of the car and it took her from 60mph to 80mph without her pressing the acclerator.

So hopefully the policeman took all this down and can verify this ot my Insurance company. However even if this does happen im not feeling very optimistic about it, Looking forward to next years premium already:(

But the thing is, regardless of whether there was a fault with her car, she did the right thing in moving to the inside and stopping. Ultimately, you drove into the back of her.
