If it's doing it with all your games then it's a problem with the 360. Get it replaced.

Weird thing is,

GoW, Vegas etc working fine straight away, pre-owned games that are marked up a little

Assassin's Creed, Mass effect, brand new, and i get this dumb message!

It's because Xbox's suck?

Mine did this a lot, get a lens cleaner disk. Think that sorted mine. It didn't do it everytime like you say though and it hasnt done it for a good 6 months.

What he said, get one of those DVD lens cleaners that has a small brush on it. They usually do the trick, or if you want a new/refurbed 360 before your warranty expires (assuming it is in the 1st year) then get MS to replace it.
