I'm in need of some advice. I recently sold my phone on eBay (See auction here) Up until the 20/06/2010 I had received no communication from the buyer and they had made no attempt to pay. I sent them a warning on the 19/06/2010 that I would cancel the auction if no communication was made by the 20/06/2010. No communication was receieved so I sent a cancellation request to eBay stating the following:
My cancellation request to eBay said:
Buyer has not made any effort to communicate with myself and has not responded to EMails sent. A final
warning Email was sent yesterday. TIME WASTER.

to which the buyer replied:

Buyer said:
I have allready agreed to sell this phone to some one for 225.00 pounds which is a big loss to me. i
would expect you to pay me some compensiation for this .

This is the first I've heard from the buyer. I have sent them yet another final payment Email requesting full payment by 0900Hrs on the 22/6/2010. However I'm very reluctant to sell to this person now as I can see him/her starting a claim via PayPal. The last thing I want is bad feedback as our record is currently untarnished :(.

Just inform him that you do not care if he has sold it on. What he does with it is of no regard to you. You are following it up as a timewaster due to non-payment and do not wish to enter any agreement regarding compensation as none is due.
 
Wait so the buyer is demanding compensation because he paid more for the phone from you than he has sold it for? Also I thought buyers couldnt leave feedback until full payment is received anyway?

He's obviously bought it to flog it on for more than he paid, which is fine. However he thinks he's entitled to compensation as I will be cancelling the transaction, putting him out of pocket as he wont be able to sell it on for profit.

That's a relief.
 
Don't send him anything, will most likely even if you sent the phone cause trouble. Once he receives it he will try to knock the price down further saying there was a mark on the box etc. Just tell him its none of your business if hes sold it on, its not your problem
 
Stop wasting your time and just click the none payer button and re-list it.
it'd really not worth the hassle to pressure non payers into paying.

Despite the fact I've sent him a final payment warning valid till 22/6/2010 0900hrs? I suppose if he can't leave me feedback it doesn't matter.
 
As you gave a deadline you might as well wait, in future if they don't respond to an email. Just file none payer straight away. There is second offer as well, can't remember how you do it, there will be an option somewhere. Or just look in ebay help.
 
Sort of off topic but selling certain items on eBay is a ****ing pain in the rear.

If I want to get rid of a mobile these days I'd rather take a slight hit and give it to envirofone or Mazuma.
 
Selling on ebay is easy, you just have to know what to expect and cover yourself with various disclaimers in your postings.

Having said that, you will always get somebody who is going to balls it all up.

Sold 2 iphones on there recently both £300> and had no problems on either one.

See if they pay... if they don't re-list.

Looks like hes waiting for payment from whom ever he sold your phone too. Just cancel it and relist, he shouldnt be selling something he doesnt own.

If he taking a loss on it, hes gonna screw you over too.
 
He cant leave you feedback if he doesnt pay

I have not paid for stuff and yet still left feedback. It was for stuff that I later decided I didn't want (a ticket for a covers band that I thought was the real band) or stuff I bought by mistake (a mobile phone box slyly listed in the phones section). In each case I left positive feedback since the seller was always kind enough to cancel the transaction
