I don't usually ask these questions having done more than 6k ales on eBay but this one has confused me a bit.

Sold a phone on Saturday, buyer paid, confirmed address, verfied member, protected under the seller's policy - no problem.

Was planning on sending phone on Tuesday as I didn't have the time on Monday to do so.

Didn't check my e-mails for a day or two, logged into eBay today and item shows up as unpaid...checked PayPal and the funds are on hold due to buyer dispute, the funds have been taken out of my PayPal and it says they are on Hold - so looks like he did this through his credit card company I assume, as normally a dispute takes 10 days to progress.

Now neither of us have the money and he is only willing to cancel the dispute after he receives the phone.

Is it safe for me to send it now? I suggested him cancelling the dispute, me posting the phone and if he needs to he can file another one a few days late (phone being sent special delivery, so will be with him quickly once he's canncelled it) but he's not agreeing to this.

Any advice would be appreciated :)

Inform paypal / ebay that you've now sent the phone. If he plays up then take it up with them.

You needing ebay help

Sounds like hes a bit jumpy, have you phoned him?, If he lives close to you perhaps you could arrange a cash on delivery option and meet him somewhere?

I would definatly NOT send the phone with a dispute in progress, too easy to lose your money

If it comes to it I would just take the negative feedback and relist the phone, just safer and with a feedback like yours it won't really make a differnce

p.s. Need to talk to you on msn next time your on

I would have to agree with that, my gut feeling is saying, if u send that phone to him, u will NOT see your ,moeny, wait untill he pays before sending the phone, sounds a little weird why hes disputing something, weird

This seems a bit funny to me. Only giving 2 days for everything to be concluded is unreasonable. He shouldn't get his hands on the phone until he cancels the dispute. What is his feedback score?

Sounds more like he's expected you to have the phone in the post at the time he started the dispute, banking on paypal's reputation for always siding wioth the buyer in cases of dispute.

WTF??? He starts a dispute with no reason that I can see, and wants you to send the phone even though he hasn't paid for it, and won't cancel the dispute until you do send it????

NO! You're seriously asking if you should send out goods to someone who's taken back the money, initiated a dispute under false pretenses and refuses to cancel the dispute unless you send him the phone which he hasn't paid for?

Is his name Mr V. Dodgy, of Shady Street, Iffytown, Suspiciousshire by any chance?

His feedback score is about 30 - 100%
This is the last e-mail from him

i was suppose to recieve item today..
you said special delivery so you had to send it out on monday, i would have recieved on tuesday. fair enough if not you had tuesday to send out.. but you just ringed me. saying you didnt.
i will withdraw my complaint when i recieve you still have until time to send it out,,, as paypal didnt gave my money back,, they keep it on a hold,, il withdraw it when i recieve this way we both can be trusted. note dont call my house no. as it's not mine anymore call me from ***********

I'd contact ebay.

I think that if the money is not in your bank already that he's trying to scam you.... especially with the " note dont call my house no. as it's not mine anymore call me from ***********"

Double check with Paypal first IMO - the way that's written looks like Standard Nigerian English.

I wouldn't trust it personally, but I would try and phone him up to talk to him about the issue. Maybe ask paypal why they have put the money "on-hold" is it at his request or something else? If you do decide to post the phone oviously get it signed for so you have RM to fall back on if the buyer says he never receaved it.

I spoke to him and he wasn't willing to negotiate - reported him as a non paying bidder and in the process of claiming the fees back.

ok.

Belive me when I say this...

You were right to not send him that phone.
You are also in your right to report him and claim fees back.

Good luck and I hope you get all money back.
Are you going to relist it?

I assume you have good feedback and a lot of it, tell him to take off the claim then you will send otherwise he will rip you off.
