Whats my chances of being successful in this claim, its the first time ive had to do such a thing. Do Ebay side with the buyer or the seller??. If worse comes to worse then i suppose i could just put it on ebay and sell it for the same price i bought it for. But then id be liable for ebay charges which i think are extortionate along with paypal fees.
Someone did this to me with a Samsung d600 a few years ago - they were actually selling the unique Orange version (which offered slightly different functionality) but presenting it as a plain unbranded D600. I opened a dispute and centred my argument on the obtrusive Orange firmware interfering with my own network operator's functions and the fact that the D600e lacked the connectivity of it's D600 cousin - eventually I agreed to keep the phone in return for the seller bearing the cost of having the phone reflashed with a generic firmware (about £25).
Incidentally how much do these N95s tend to go for second hand? Ordinarily I'd sign up to Vodafone and get one but I'm currently on Tmobile's flext35+WnW and would prefer to keep the tariff.
