My car just got wheel clamped!!!

You now have 24-48 hours to pay up, or your car will be taken away and impounded. Then you either have 7 days before it gets crushed (if its not worth much) or 14 days before it gets sold at auction.

PK!

Well... you have, as your car is now clamped. The moment that car touched the road without a tax disc on display you were gambling on not being caught, whether you knew it was against the law or not.

Where was the car when it was clamped? That is your only possible get out clause (IE if it was on your drive).
If it was on the road you're screwed as you must have it taxed if it's on the road.

You should have made sure the car still had valid tax when you arranged to buy it. If it didnt then either get the garage to tax it or get it yourself then pick it up.

How am I supposed to know.

How do we all know?

Ignorance is no defence. You drove your car without tax or insurance. If it isn't newer than 3 years old without MOT too. You're lucky it only got clamped.

I am now just really annoyed!

No-one to blame but yourself I'm afraid.

I never take gamble like this!

Except today? I'm sure that defence will stand up :)

Do I still have to pay, even though I have a geniune reason not to have Road Tax?

Yes, you still have to pay. This is because you do not have a valid reason to not have tax.

Tbh there isn't a valid reason, you either have it or you don't, its an absolute offence, no way of wriggling out of it...

There's been cases in the past where a car has been SORN'd and the owned has still been clamped. Happened in a private car park near here.

The DVLA now require the clamping agency to take photos to prove the condition, location and lack of tax disc on a car. With all these checks its unlikely they'd make a mistake.

I do a bit of admin for a few of these contracts around the country.

PK!

I ain't no Tax dodger and never been and this happens to me, is quite a tad annoying.

I now have to pay £200 to this umbrella company!

I am so racked off now!

I didn't call you a tax dodger, and no-one else did either, but you gambled and lost. Unlucky, but ignorance of the law is no defence.

I want to challenge this LAW, where it is compulsery for traders to have a tax disc on cars they sell!

People like myself can't get hold of instant Car insurance certificate!

I assume as you had no tax it also had no insurance?

You really should have looked up the basics of buying a car. This is what Google and Dad's are for.

EDIT - re reading your post I dont think you did have insurance and you should count yourself lucky you just got clmaped and didnt crash in another car.

This thread remind me of this:

The Simpsons said:
Homer: You have 30 minutes to collect your car
Homer: You have 10 minutes to collect your car
Homer: Your car has been impounded
Homer: Your car has been crushed into a cube
Homer: You have 30 minutes to collect your cube

*phone rings*

Homer: Hello, Mr Burn's Office
Burns: Is it about my cube?

There is no reason to take the car away straight away is there, your telling me you could not have left the car in the garage another 48hrs.

Also if you was to have an accident with no tax i can guarantee that you insurance would try wiggle there way out of any cost which you may pass onto them.

Its your own fault and IMO its a good law, i bet you wont let it happen again, it also stops people who are TAX dogers driving in uninsured/untaxed cars.
