Hello my girlfriend is AUS and has a 2 year visa to be in this country 1 year of which she can work here. The working part of it has almost expired, and she has just found out her work will not sponsor her.

She has grandparents that are english so she can apply for a 5 year ancestory visa.

Is there any way she can do this in europe instead of going back to australia otherwise she may have to leave her job.

Any information or usefull links would be greatly apreciated as we are both really pannicking about this!

Thanks in advance.

One would have thought you'd have looked into this before moving over, or certainly before an impending deadline, which this appears to be.

Your best bet is to contact the home office.

Not quite like that im english and she was assured that her company were going to sponsor her but it has all fallen through at the last hurdle.

A very similar thing happened to a friend of mine last month actually. If you marry she would be allowed to stay no problem. Especially if you can prove you've been in a long term relationship (photos, letters, joint bills etc).

We have only been together for a year still a bit too soon.

I am outraged that she cant stay longer there must be something we can do. Im just praying the ancestory visa will work. Does anyone know you can do this?

I am trawling through the link that was given above as we speak.

I'm British so haven't had to apply myself here before, i've worked in Canada and you can apply for visas/extensions from within the country. Their immigration policy is always reported to be one of the strictest so it could well be possible to do the same in the UK.

Why is it necessary for her place of work to sponsor her? Surely if she has a job + proof she can support herself financially thats grounds enough for a standard work visa?

Why outrage? The Visa laws are quite clear.

What good is a cynic who knows the price of everything and the value of nothing? :)

The Visa laws are ridiculous, terrorists get state benefits, whilst decent and intelligent people, in some cases deadly ill people, are all removed. Or in this case, good people have to leave to simply adhere to a pointless formality of having to apply from abroad, rather than locally.

It is a disgrace.

I'm Australian, and came to the UK in January 2004 on a UK Ancestry Visa. They are not hard to get, provided that you have the right documentation and can demonstrate that you have sufficient funds to support yourself independently. This is important, because your gf will have no access to public funds. Benefits of any type are completely out of the question; she can use the NHS and that's it.

She will need to show that one of her grandparents was born in the UK. The best way to prove this is to write to the Home Office with details of said grandparent and request a copy of his/her birth certificate.

TBH, the only easy way to get into this country is if you're from an EU country or have semi-recent English heritage. If you're from Aus, Canada or the US for example, it's much more difficult.

From the sounds of it, I think she's on a Working Holidaymakers Visa. If so, she may have a bit of trouble as one of the conditions of that visa is no extensions. However, I know there are some exceptions and the Ancestry Visa may be one of them. I know my WHM visa runs out this summer and I'll be getting married in June which allows me to extend my stay for an extra three months while I apply for a permanent visa.

Best bet is to call them and find out for certain. You don't even have to give your real information.

My thoughts exactly!!!

I am so angry about all this!

We have been together for a year adn living together for 4 months, and she could end up losing her job of nearly a year becuase she is forced to go back for a long period of time!

Is there anywhere in europe she can apply for an ancestry visa?

She has all the relevent documents.

I really am so appauled that someone who has worked in a very good job paying an insane amount of tax has to return to her country just to apply for a permit to stay here. Will cost almost £1000 and possible her job.

When there are people living in this country who have convictions etc.

There must be an easier way.

Well as already suggested the only other option to get married. To be honest though she knew the terms and conditions of the Visa when she applied for it so she should have all this planned.

It is unlikely that she will get a work visa as the company she is working for would need to prove to UKvisa's that they cannot find somebody suitable within the UK. (She has a working holiday visa at the moment so the company wouldnt have had to do this yet).

Contact the Home Office about where she can apply but she can't do it in the UK.

This may not seem fair to you but conditions of a working holiday maker are the same for everyone. If she wants to live and work here and is able to get an ancestory then it shouldnt take too long and its a pretty simple process.

IIRC she has to be in Australia to apply for the visa. That's how it was for me.

Paint her brown and train her to forget all English other than "Asylum".

Pretty much what i was going to say.

Except you also have to shred passports and claim that you dont know what country you are from. At least this way you will both get a new house, car, money, vouchers etc.
