Ok concerning that, you do not have to have the keys with you to be in possession of them.

If they are somewhere that you have access to (my example being your holiday home in Devon), then you are in constructive possession of those keys.

Therefore you are in charge of that motor vehicle, whilst being drunk. Voilla, offence commited!

Would you like me to explain constructive possession?
P.S. don't get too caught up in any of this, like I said, it would never get to court or be punished. But it doesn't mean that the offence is not taking place.

Seriously, your making stuff up now. The RTA doesnt even mention the word 'possession' in its explaination of 'in charge of', let alone 'constructive possession'. Ill find a bobby tonight and ask them
 
Idiots like you are why I (young drivers in general) have to pay through the roof for car insurance. I don't even know where to begin, but I have a hunch a fair few here has already said what needs to be said.

Get a grip, sort your life out. It's obviously a complete shambles if you're drinking and driving without insurance.

i have to pay through the roof anyway for insurance and im young..

why?? so im scum for this when everyone drink drives all the time and i wasnt even driving. ive never done this before..

If everyone cut their wrists would you do it?
And define "everyone" I'd wager that the majority of motorists don't drink drive.

Why do you need to be near the vehicle to be in charge of it?

If you go on holiday and leave your car at home, are you saying that you are no longer in charge of your vehicle? If you own it, you are in charge of it.

Mike, look. We get your point, and we all understand what your trying to say, but your comments are not working in your favor. Owning something does not make you in charge of it. If I own my car and my sister drives it she is in charge of it, not me. I can be as drunk as I like, hell, i can be slumped in the rear seat off my face for all I care, there is no offence.

Yes, using or planning to use a car while drunk is an offence, but common sence over rules the wording when you seperate the intent or even the posibility of being able to drive.

They don't care what you say, you do not have paper work to show you are insured. End of. It was on a public road you need Third party insurance. Regardless if you where driving or not.

I dont have the paper work but the ppl i bought it of will. i would be insured third party anyway, i have the papers for that.

:rolleyes: i give up. i have remorse i didnt answer my phone or messages all day after i got out i was so depressed about it.
