Accident - blame not entirely apparent

I think this was mostly my sister's fault, but the accident was approximately as follows:

She was parallel parked and pulled out so the car was about 45 degrees to the curb and the front wing was sticking out. For whatever reason she then hesitated and stopped in that position. She said she was waiting for cars on the opposite side of the road to pass or something stupid which there was no need to do since it was a wide enough road.

Anyway - a car then came down the main road and took out her right wing and knocked the left wing into the car parked in front of her.

Is this her fault, his fault or will it go knock for knock? No independent witnesses.
 
His fault. She was stationary at the time of the hit? Cant see how this could be her fault.

But im taking it as she was stopped dead for a little while?.. or did she pull out stop and bang all within seconds?
 
Hitting a stationary car is always the moving cars fault (assuming she was stationary when the other car first came into view).
 
I'd say if was her fault. She is either entering the highway or not. As she stopped she should have reversed so that the car wasn't sticking out.

If she did the same thing on a t-junction and a passing car hit her it would be her fault.
 
I find it hard sometimes to pull out in one go when parallel parked on some roads in my town centre just because traffic is quick to appear and disappear, especially as there are roads coming in at right angles behind me and the spaces are short. I imagine I have in the past pulled out a bit, let a car past, then continue.
