Illegal downloads

if thats the case how do they know you are downloading copyrighted content?

Because of the torrent specific data? They download illegal torrent X, and any one seeding that, encrypted or not are uploading illegal packets. Its not a case of 'you could be a peer, and uploading something else which isnt illegal'

Encyrption protects you from your ISP knowing if its legit or not (well, if they snoop do packet inspection), these companies just connect to the tracker and see whos doing what...

My Dad downloaded the movie Signs through Kazaa a few years ago and we got a letter about it.

Still, we still download but now we use encrypted SSL Usenet and have been for years, sometimes I have months of absolute download fests, think the most I've done is around 500Gb a few months ago, but no letters in years now.

As for all the moral high ground people, downloading is NOT theft.

It's like, if I go into a shop and make a copy of something, I'm leaving the original item intact, nothing is actually getting stolen, no I'm not trying to justify my downloading I don't really care, but it's still not theft. I don't distribute as you don't have to with Usenet, you download only no uploading is done while downloading.

That is not legal argument.

Correct me if I'm wrong but ...

Piracy is not theft, it's copyright infringement, one is dealt with as a crime, the other as a civil matter.

I believe that to be the case. Usually it is dealt with in civil courts, which can in itself cause it's own problems for defendants as the requirements to prove guilt are nowhere near as strict as in criminal courts. Copy infringement will end up in a criminal court the minute you start profiting from it.

It is dishonestly ripping off someone else's work though isn't it.

Have to LOL at the "moral high ground" comments. if you're happy being dishonest that's an issue for you don't take a pop at people for saying trying to be honest is a good thing

What do you actually download to get through 500gb in a month? o.O

Personally ISP's never gave a toss about illegally downloading and now that large media companies like music and film organisation companies and UN have told they will be fined for their customers downloading illegally.
Personally it is my internet conenction i can do what the **** i want to do with it.

But their is always going to be something that defeats ISP cracking down on downloaders.
Also the music industry that is making the most huff about it havnt changed their business model a hell of a lot since say 20 years ago where everything is on a computer and a lot of their sales is relied on CD's.
But i do like some of the steps done to move the industry forward like Radiohead releasing there album without charge if the user did not feel they had to download it.
Music industry get smart or expect to lose more profits.
