Quantumeazer Space gun! 18+

Hmm, I wouldn't have thought that the courts would count those as imitation firearms myself, but perhaps I am mistaken. If anything, it isn't specifically worded, its very vague.

The reason I say that is because the other part of the law specifically deals with "realistic" imatation firearms. If some are specifically mentioned to be "realistic" then the other section must deal with all guns or it makes no sense.

to be honest i would have asked some mum/dad to pop it in thier basket and buy it and given them a couple of quid. itll cost you that in the petrol to get back down.

A bit of detective work reveals:

Serious Crime Act 2007 (2007 c 27) said:
“imitation firearm” has the meaning given by section 57(4) of that Act; Theft Act 1968 (c 60)

Theft Act 1968 said:
“imitation firearm” means any thing which has the appearance of being a firearm (other than such a weapon as is mentioned in section 5(1)(b) of this Act) whether or not it is capable of discharging any shot, bullet or other missile;
Again, in not sure how the judges would rule such a toy as meeting this criteria. We need to look at common law cases. Sadly, I'm unable to find any, although I havn't spent long looking.

I am training to be a lawyer yes, although I am far from vastly knowledgable in the subject. I am writing an essay on statuatory interpretation at the moment. Of course, if anyone wishes to correct me then I would happily change my possition.

No you're right, you just sound very 1st year law to me :D (no offence intended at all)

Oh how old graduation year makes me feel.

Why did you want one anyway? :/

I didnt I just thought it was funny to do a bit of a write up :p

LOL. Bet you well gutted mate.

Yeah :(

And if I'm honest.. I felt like pistol whipping the old woman then holding the store up :o

They wouldn't sell lightsabers either apparently...

LOL no wonder all the stores stores I've been in seem to have about 100+ light sabres still :D

/Fail for not looking your age :)

/Fail for believing that I attempted to purchase it :D

And FYI it's quantumfazer.

I realised this when the other piccy was posted.. But I couldn't edit the title :o

lol :D Good idea but I wasn't really going to buy it :o:D

edit: Also although I haven't replied to any of the law/legislation stuffs, I'm finding it a pretty intresting topic (I've got some basic law knowledge from doing a business law module at uni)

Haha yes, I am aware I do probably sound like a bit of a novice eager to use his knowledge :D

I am a postgraduate doing a 2 year qualifying law degree, but I am a first year newbie to law.

You are so very wrong. They are infact most likely to be the cause of harm to the person wielding said imitation gun.

So I am right they can't hurt anyone, the police can shoot them, but that's completley irrelevant. I could say I had a bomb strapped to me on a plane, we would then have to ban clothes too in case someone shot me. You'd end up like equilibrium where you ban emotion to stop people commiting crimes.

It's not completely irrelevant at all, as they clearly can bring harm to people...

To the user, not to the public. So it is irrelevant. Do you want to ban fatty food as well in case someone eats too much and has a heart attack? That is actually less far fetched than bannining imitation weapons in case someone robs and bank and then gets shot.

if i was going to hold up a post office it would be really tempted to cover whatever gun i use in a big plastic spacegun case !

Why if it is classed as an imitation is a child on the box playing with it? Contradicts itself! :p

Rich

We don't know if it is legally classed as an imitation firearm or not, we would need case law to confirm that. It is shops wishing to be safe rather than sorry.
