Hmm, I wouldn't have thought that the courts would count those as imitation firearms myself, but perhaps I am mistaken. If anything, it isn't specifically worded, its very vague.

The reason I say that is because the other part of the law specifically deals with "realistic" imatation firearms. If some are specifically mentioned to be "realistic" then the other section must deal with all guns or it makes no sense.

“imitation firearm” has the meaning given by section 57(4) of that Act; Theft Act 1968 (c 60)

“imitation firearm” means any thing which has the appearance of being a firearm (other than such a weapon as is mentioned in section 5(1)(b) of this Act) whether or not it is capable of discharging any shot, bullet or other missile;

Again, in not sure how the judges would rule such a toy as meeting this criteria. We need to look at common law cases. Sadly, I'm unable to find any, although I havn't spent long looking.

edit: Also although I haven't replied to any of the law/legislation stuffs, I'm finding it a pretty intresting topic (I've got some basic law knowledge from doing a business law module at uni)

Haha yes, I am aware I do probably sound like a bit of a novice eager to use his knowledge

I am a postgraduate doing a 2 year qualifying law degree, but I am a first year newbie to law.

You are so very wrong. They are infact most likely to be the cause of harm to the person wielding said imitation gun.

So I am right they can't hurt anyone, the police can shoot them, but that's completley irrelevant. I could say I had a bomb strapped to me on a plane, we would then have to ban clothes too in case someone shot me. You'd end up like equilibrium where you ban emotion to stop people commiting crimes.

It's not completely irrelevant at all, as they clearly can bring harm to people...

To the user, not to the public. So it is irrelevant. Do you want to ban fatty food as well in case someone eats too much and has a heart attack? That is actually less far fetched than bannining imitation weapons in case someone robs and bank and then gets shot.

This country has gone to the bloody dogs when you need ID to buy a multi-coloured toy gun.

Can it really be mistaken for a firearm ? I doubt it.

And we've seen how much crime that creates, pimps, gangs, theft and drug dealers.... and people dying from overdoses and contaminated drugs.

We don't know if it is legally classed as an imitation firearm or not, we would need case law to confirm that. It is shops wishing to be safe rather than sorry.
