Sold a phone but buyer wants refund, where do I stand?

It just seems like the right thing to do. That way you haven't lost any money, and the buyer isn't left with a dud.

Surely as the original buyer of the phone, it can be replaced again?

It's not his problem though. As far as he is concerned the transaction is over and complete. If he sent it working and it broke whilst in the buyers possession then it is the buyer's problem.
 
The warranty on the phone has ended so to repair it I will have to pay, which I don't feel the need to as it was fine when I had it. If I send the money with paypal gift to my sisters account, paypal can't take back the money right? I'm considering doing this in case he disputes soon.

i feel strongly about this as i trade on ebay, and people try this sort of thing all the time. you can't go refunding people willy nilly or you may as well not trade. i have had items in the past where i was not sure on and have refunded. but if i check an item and no it to be good then as i have said to buyers. sorry but i can't help you.
 
You need to find the rules with paypal gift but I would assume they can not dispute it at all.

Where do I find this, I've always have had problems searching for terms and conditions for paypal gifts. If anyone can direct me to it, it be much appreciated.

Not sure, as I can't find it either. But before you decide anything that is what you need.
 
Other forums are stating that a paypal gift is totally unrecoverable and even if someone uses a credit card to refund then Paypal will seek the money back.

So looks like you're totally safe.
 
Tell him that he's had it a working week and anything could've happened to it in the mean time. He shouldnt have left positive feedback until he was happy. No refund, end of story. Too many people out there trying it on.

+ in future take photos of serial numbers or distinguishing marks as there's people who get refunds by sending there broken items back and keeping your good item.
 
As other people have said, you shouldn't refund imo.

I would be annoyed if it was me, but he had it for a while and should have tested it before leaving +ve feedback.

He even said it was working at first, and then stopped, i.e his fault, not yours.

Of course they can take the money back. You will have a negative balance and it could easily lead on to debt collecters. Not having money in your account does absolutely nothing to protect you.
 
As it's a phone should it not have an IEMI number? If you don't have that you really should make sure you keep it in future!!
 
My thoughts:

1. You were silly for not keeping a record of serial number, macro photos of inside and outside to prove condition, but hey, gotta make a mistake somewhere and learn from that.

2. You can't just take his word for it that it hasn't been used since purchase. He should have checked it was ok before use. For example, for every electronic purchase on Ebay, I make sure they work for at last a week before leaving feedback.

3. He paid by Paypal gift, I doubt he can get a refund now anyway.

So, you're in luck I guess.

I'd answer once, and at least he'll know why you'll ignore further emails. Ignoring all emails is definitely not on, even if your conscience is clear.
 
why doesnt he contact apple regarding a replacement? as you stated and he accepted it "was" working perfectly.
plus he has all the documents too.

As said, i'd just let him know that it's too late now as he left feedback, and wish him well in all his future endeavours. ;)
