3D Realms sued over Duke Nukem Forever

and as someone else mentioned, the full rights to the duke nukem franchise and whatever else they've done over the years, but i guess if take two dont have a team of actual game developers that would be quite useless. are they purely a publishing company?

They could always licence it out to another developer. i.e, rather than supplying money to develop a game, just giving them the material and getting returns on the finished product.
 
So how are 3D Realms supposed to pay Take Two back if they've gone under due to no money?

They will go into liquidation to pay off their unpaid debts. If Take Two win their case they will become part of these unpaid debts.

But yes, if they have no money, these debts could be wiped out.
 
Am I missing something? What's the point of suing a bankrupt company?

Because if you can't get the money, you might be able to get the IP.

Alternatively a court mandated settlement puts them high up the list of creditors in bankruptcy proceedings
 
I've seen a video from a beta leak and it was great. It looked great! No idea why the cancel it. Sue 3d realms won't make any difference though...
 
After 12 years they must have something to show for the $12 invested, they should release what they've got, as already said somebody will do a mod for it & possibly make a great game of it.
 
Apart from the fact that they didn't get the 12 million, and they switched engines several times so i dont get why the clock wasn't reset when that happened. Guess the 12 years bandwagon seems "cooler".

Whatever its still 12 years total for time spent on one game that will never come out.
 
i remember sometime aaround 98-2002 there were some shots of the game in pcgamer and it looked like it had better graphics than anything else around at the time so i dont know why they needed constant engine changes.
 
I think we will see another Duke game in the future it may not be this one but I do think this legal battle will really be not getting 12 million back but all the rights for future releases
