I sold something on eBay and the buyer says it doesn't work. What shall I do?

The thing i dont get is that i did not state any warranty or returns in the advert. I still duno how they can ask for their money back etc.
 
because they paypal/buyers think that you may intentionaly sold faulty goods.

if it doesn't work on arrival tey will think that.
 
Feel for you mate.. I hear so many of these horror stories of ebay. Every time I sell something on ebay I pray that the person who wins the bid isn't an arse. Sounds like you got a right **** who bought your card.
 
Just noticed the person has bought another hd3850 a (edit tis a powercolor) one i think it was. Wonder if he gets that to work.

if it goes to debt collection agencys, say right fine take me to court because you know your in the right, and you can prove it... honestly itll soon be dropped.

i've had a phone company (not saying which) trying to get monies off me for a unsettled account balance, which i shouldnt have to pay, and i know this (long story) its been on going for about 6 months now, one agency gave up, another tryed... heard nothing since.

Paypal reserve the right to take back the money in the case of a dispute. It should be up to you(the seller) to prove that you are in the right in a buyer seller dispute. Closing your account and severing your bank account link means nothing. The burden of proof doesn't magically shift onto them because you have done that.

The problem with this is, skeet doesn't have any proof of owning the card working except a few screenshots and 3dmark benchy's I think.
 
He has all the proof to win a dispute... IF paypal handled this fairly - in the exchange where he offered a refund if the item was returned... the buyer so far has not fulfilled the terms required prior to the filing of a dispute - unfortunatly paypal seem to default judgement to whichever is easiest for them - so you gotta keep hammering home that you are in the right...

If they do threaten to send teh baliffs then you need to hammer this point home even more - coz you would win in theory should it ever come to court.

Personally I would get back to the buyer if they win the paypal dispute and inform them that if they don't return the card within a reasonable amount of time you fully intend to take it to small claims (moneyclaim website ***). Might be enough to make them think twice hopefully.

Oh, didn't know they had to comply before starting a dispute, then skeet is easily sorted :).

Your last option sounds very reasonable too.
 
Theres certain steps your "supposed" to take before filing a dispute - that in theory would help prevent scamming - in practise paypal seems to ignore their own guidelines and just go in favor of the easiest option for them... or the cheapest - so theres a small chance if the guy still has an account and the OP doesn't they will find with the OP.
 
If you had a broken 3D card that you sold on ebay as working, which was then sent special delivery would you be able to claim damages from the royal mail for damaging the item? As you how would they know it wasn't them that damaged the item in the first place? O_o

You have to show them the damaged packaging to claim successfully. What you're suggesting is fraudulent.
 
Case has been closed apparently in the last day or two. Not sure if they found in favour of the buyer or seller or what since i couldnt read the resolution thing on paypal. No emails yet off em either. Still no feedback given to the other seller with which sold a hd 3850 sold to my buyer after 2 weeks now. Asked him for a update no reply yet.

Im wondering tho if the buyer had problems with that other hd3850 and has closed the case they had with me due to the other not working on his comp? So very confusing.
