i've had a phone company (not saying which) trying to get monies off me for a unsettled account balance, which i shouldnt have to pay, and i know this (long story) its been on going for about 6 months now, one agency gave up, another tryed... heard nothing since.

He has all the proof to win a dispute... IF paypal handled this fairly - in the exchange where he offered a refund if the item was returned... the buyer so far has not fulfilled the terms required prior to the filing of a dispute - unfortunatly paypal seem to default judgement to whichever is easiest for them - so you gotta keep hammering home that you are in the right...
If they do threaten to send teh baliffs then you need to hammer this point home even more - coz you would win in theory should it ever come to court.
Personally I would get back to the buyer if they win the paypal dispute and inform them that if they don't return the card within a reasonable amount of time you fully intend to take it to small claims (moneyclaim website ***). Might be enough to make them think twice hopefully.
If you had a broken 3D card that you sold on ebay as working, which was then sent special delivery would you be able to claim damages from the royal mail for damaging the item? As you how would they know it wasn't them that damaged the item in the first place? O_o
