Technically they can offer to repair it first, as its older then a month. Your rights allow you to demand a replacement / refund if they were unsuccessful with a repair.

But in real circumstances, Orange won't bother and just replace the device.

But they have already been asked to replace the device,(in any way they see fit) and they have refused up to now.

A warranty can say what it wants, legality has nowt to do with what any company wants to write into small print, when it gets to court.

All/most items for sale are guarenteed for a one year period.

And if life expectancy is shortened then you can still claim.

IE Tv that breaks down after two years, the courts will still rule in favour of the buyer for a free repair.
Ie when life expectancy of tv is five years.

I have phoned the lady but she does not answer yet.

I am looking into this for the daughter anyway, because whatever Evangelion says the internet IS the big book which we can all read at our leisure.

Here's your big chance.

Basically, as of the 14th of Sept, Orange are changing their out of bundle charges, they will be notifying all of their customers before that date of the changes.

The interesting bit is that if you are in a contract with orange and they change something that may be of detriment to you (In this case increasing the minimum call charge to 15p outside of your bundled minutes) you have the right to end the contract early with no fees.

I made the call this morning (150 from your phone, press 1, then 4 then 3) and my contract will be wrapped up as soon as I have used my PAC code they are sending me.

10 months early.....

A friend of mine has done his tonight, and only got his contract from me 1 month ago!

This is perfectly legit and above board, and you are simply excercising your right to use the T&C's in your favour.

It works nicely for me as I don't get orange signal at home, and now I have a W995 that I can use with an O2 sim only and save some cash.

I really don't understand why you can't grasp the simple concept of the legal contract into which this woman entered. Dolph has explained it very well, and I pretty much said what the gist of it is.

Follow the warranty procedure, get it replaced for free under the terms of the warranty, get on with browsing.
 
Sorry, i got sidetracked by the legality of contracts because no matter what they say most are not legally binding anyway.
It is a bugbear of mine.
 
This friend of my daughters has found that because of her broadband use, she has run up bills of £50 more than expected, that is on top of the monthly contract.

She does not have that sort of money.

Surely there must be somthing in law which says what you can afford, etc.

She wishes she had never signed in the first place, but she now says she knew nowt.

Nope, that is why you have to read contracts and why we don't allow under 18s to sign them.

If she can't afford to pay at all, get in touch with Orange ASAP and work something out with them, rather then just not paying as it will screw up her credit rating quickly otherwise.

This is why you don't let a kid have access to mobile internet it's fiendishly expensive if you go over the limits. Dolph works for Orange btw so listen to what he says.
 
I have just got a call from the woman who has this problem.

She told me she has been to town to the shop, and they sent her packing(i wish it was me). Biff. Pow, Bop

I have now sent her down the Dolph route.

She said she will phone me soon after.

a 50quid bill is insane though. But hey thats what you get for letting a child use mobile internet without knowing the actual cost.

tbh (and I might be going out on a limb here) but even those the women in question might not be tech savvy she must have had some idea of how much this contract was going to equate to before signing it ? I mean if money is tight surely she would have asked how much this contract was going to cost an all ?

Also I doubt the whole going to court over a dongle is a very smart move.....

Also with regards to warranty Dolph is 100% correct in his post.

I feel for you honestly its crap seeing friends being mis-treated but sadly they got themselves into this mess they gunna have to get themselves out.

now i am not saying the same applies but there do seem to be a lot of single mothers who get in the shi............

IE you can always say NO.

Yes single mothers do get in the **** and a lot of the time they get themselves there ! its not an excuse to use just because she is a single mother it does not mean she gets special benefits (oh wait......)

I'm not here to argue with you buddy. But you just seem to want to protect her even though she got into this mess on her own accord.
Shops are there to make money. Sales employees are there to make the shop money. People who go into the shop give the shop money its how it all works.

Yea she may have got a crap deal but thats life. Deal with it

You should have gone down the Dolph route in the first place. The guy knows what he's talking about as he works for, or did work for Orange himself.
