Cars clamped... WTF?

I don't want to read the whole thread, but that would be rudiculously easy to cut off, you could do it with a hand saw with a tungsten steel blade. Angle grinder would be overkill.
How about bothering to read the thread before making the same comment that has been made many times already, and that is not the focus of the thread anyway.
 
Cut it off. Cut it into little pieces. Send the pieces back to their office. Include an invoice for damage to your car, lost earnings as a result of losing work hours, and postage of the clamp.
 
Who is responsible for the upkeep and maintenace of that area ? If it is you or the tennants or the landlord - basically anyone but at public expense then it is private property and the clampers have no right clamping your cars.

Well I will explain in more detail later, but I have statement from council saying it is private as per the email above the MV posted and are trying to work out if it is communually owned in deeds, or a name.

DVLA softloader arrived ten minutes ago, went flying out the house in my boxers. Guys started to move the car, got onto the boss on their mobile who said yes its private but no one knows who so the cars are coming to me.

LOL not. Let rip into the div ******* boss Ian, who is now going back to the council for more clarification, as am I. Two guys shook my hand, think they liked me giving their boss it tight. Said they didn't want to move the cars to bring them back, and that they might refuse to lift them because of the land despute.
 
Put up a sign in the car park saying that cars not belonging to the residents of these flats may be clamped with a release fee of £10,000. Make sure your sign is compliant with whatever the regulations are for wheelclamping signs in Scotland (correct font size etc.)

Next time the ****ers arrive, clamp their tow truck, van, whatever.

In the meantime check your car for any dents, scrapes or other damage that was caused by loading the car onto the tow truck and send them the bill, including the cost of a recovery truck to transport the car to and from the paint shop since the car cannot be driven on the road due to being SORN.
 
lol do you think I give a hoot what others thinks? I clean the cars and pump the tyres every fortnight.

So it is private but also an adopted car park which is lockable? I just want to know the councils legal position on this so I can consult a lawyer, because somewhere down the line ownership of this carpark has been taken over by someone from the Factor.

The DVLA are not taking my word on this, so without a statement from the council I am at a loss what to do and will lose the vehicles.

I have just spoken to a ECC Enviromental warden inspecting a car on my street. Unfortunately I did not catch his name but I think he is coming to speak to you.

According to him he would not clear any refuse at all from the back carparks beyong the locable gates in the x estates regardless of where ever the refuse is situated within them, ie the grass or tarmac carpark. According to EW the land is private with regards to their work. If that is the case there is some questions to be asked over council handling overall of this issue dating back to the procurement of the properties.

I seem to be getting conflicting information and I now have several neighbours on the phone to the council and going over title deeds concerned over what they have done to land that was legally ours.

This will have ramifications above and beyond my two vehicles, especially when applied to the rest of the estate. Land upkeep and work done to private gardens.

Is it possible to have an adjudicator come down and assess this in person?

It may come to that.

I would love a police officer to come down and try to sort this out between angry angly the grinder, NCP and ECC if I lock the gates up.

In the mean time its with lawyers costing me ******* money. Grrrr
 
Heh, this is going on for some time. If you've been dismantling bits of your cars, can you not just remove all the wheels? You know, as well as following your current path of investigation. Would be amusing (to me). I assume as the cars still belong to you you are allowed to clean them? Taking the wheels off is a requirement. Hurrah!

I'm totally in this camp - how are you even letting them give you the runaround?

You're having to phone lawyers, chase it up, watch the car in case they take it, etc.
