The contract would need to terminated in some form, and that would have to come from BFG's side as Nvidia are not going just going to let them walk.
Nvidia may be in breach, but we will never know, so no point in talking about it unless we have some evidence. If BFG did have grounds to terminate and wanted to go they would have.
It would make perfect scene. Nvidia are seen as the premier graphics card company, and as could replace BFG with any amount of willing company's. If you look back at some of the business decisions Nvidia have made, you will see thay are a *highly competitive group* prepared to go to great lengths to get what they want.
If BFG went to ATI it would hurt them a lot more than if they closed down. I bet they could replace BFG with a second class partner and work out a better deal for themselves. It would hardly impact on Nvidia at all with the current state of production. (Whilst getting the new cards ready.)
We cant debate as we don't have the contract in front of us but I think it safe to say that if any of the major Nvidia partners could have done deals with ATI they would have.
