why can't i sell my windows 7 ultimate

I did some training and was lucky enough to get a win7 ultimate edition, it comes in a plastic sleeve, aposed to the retail box (not the party pack one) having all three of my rigs running win7 pro i had no need for it and listed on ebay,

2 days later ebay remove it and ban me for 1 week... (a little harsh i think)

yes the disc says not for resale, but surely if i entered a raffle (as i did at the training) and won it i have the right to sell it? can MS legally stop you for selling something?

can i give someone a a present and write 'not for resell' and then make ebay remove it ?

I think the clue is in the 'Not for Resale' bit... it's not rocket science.
 
What it basically boils down to is corporate greed, it's just the way of the world in these times.

They have more money to spend on lawyers than you do.
 
Well they were given out free, so greed doesn't have a lot to do with it. If you object to not being able to resell it you can always send it back to MS and get what you paid for it back :P

Possibly not, if they only gave you it on the condition that it can't be resold.

I can't claim to know how the law would actually interpret such a restriction on an item, but I don't personally see how you can be too annoyed at not being able to sell something which you received for free.

i do understand that, when i entered the raffle it was not mentioned it just said 'free copy of win7 ultimate'

it just bugs me that they are allowed to print that on the package and for that reason i can't sell it on ebay or ocuk for example, i have no need for it, but also aware of the retail value.

Obviously, if it was me, then I'd prefer to be able to sell it too :D

But I can kind of understand why they wouldn't necessarily want people selling copies that they've given away for free.
 
Why not simply install that version on your rig and then sell the version it replaces?

Assuming for the moment one of his other installs is Retail, he has the issue of it already been opened and used.

I wouldn't go within 15 miles of a copy of Windows on eBay, nevermind one that had already been used.
 
would you be able to sell it in MM, not sure on the rules for items like that but might be worth asking a mod and sell it there?
 
Why dont you put it back in a raffle?
You paid nothing for it so complain when you try to make on it? :D

This is a quite amazing thread.
An item given away as "Not for resale" and the OP is moaning because he can't resell it.
I've got a Windows Vista and Office 2007 copy here which says "For Educational Use Only" on.
So by your logic I should be able to do with this what I like?

You won a free copy of Windows 7.
It wasn't OEM, it wasn't retail, it wasn't educational it wasn't VLK (each of which have their own and very different license agreement).
It was a special "Not for resale" version - which funnily enough you can't resell.

Fully agree with SteveOBHave's post - it really is simple.

I agree with him. It's not hard to figure out really.

Surprisingly, the phrase 'not for resale' means 'not for resale'. :eek:
