I suspect the legal reason is licensing - you've won the item, but a condition of the license given to you is that it cannot be resold.

The business reason of course, is that they don't want people profiteering from their giveaways. Think about it, every person that buys a gift version of Windows is one less customer that might have bought it from them. This is actually quite common and goes beyond Microsoft and computer software, prizes (e.g. tickets to an event) are often non-transferrable.

SteveOBHave is right. It's not a retail product because Microsoft gave it to you; they don't want people abusing their promotions, which is fair enough IMO.

When people abuse promotions, companies stop running them, and then everybody loses.

it just bugs me, if they give it to you or you obtain it legally you *should* have the right to do whatever you want with it.
Some people also just accept everything they don't need ;)
having all three of my rigs running win7 pro i had no need for it and listed on ebay,

Jimlad, how about just listing it without a picture of the actual disc?

Realistically, the not for resale bit is to stop retailers stocking up on cheap discs and licenses and selling them for mega profit.

It's not really intended to mean for private sale, as you've said yourself, there's nothing they can really do is there?

Would they be against you giving it away? Then the person you give it to decides to be generous and gives you some money?

How about trading it for another physical item? Is that also wrong too?

Ignore stoofa, he'll try and bully you in to accepting that what you're doing is piracy, then try to tell you that you're a thief (he's part of the "piracy isn't piracy, it's theft, the same way that theft isn't theft, it's murder" crowd).


If it comes down to law, can you really see you being, legally, disallowed to sell this?

You aren't a retailer, the message isn't about private sales, same way that things on multipacks say "not for individual sale" on them.

Say you're buying a multipack of something, and your intention is to go "halves" with a friend, but they're not with you so you pay the full amount and they will reimburse you later.

Now, they say not for individual resale on them, but technically speaking, you're selling half of them to your friend because you've paid for them in full, then split, gave half to your friend, and taken the money off them.

Oh noes! He's selling them individually! :rolleyes:.

Let's bring some common sense in to the situation, who is the message REALLY for? Shops? Not to be sold individually retail?

Some people on here need to stop being so self-righteous, it's ridiculous.

appreciate the comments, lots of self righteous posts in this thread, i bet everyone in my boat would do the same, i have a work win7 pro licence key so i can install on as many of my pc's as i want, no need for me to have ultimate, but just because i got it free does not mean i should give it away, i do plenty in that terms, working for a youth group and helping less well off families on a local estate. I don't need to feel bad or guilty for wanting to sell something i have no need for
