"Injunction" on my car :(

Firstly it won't be a section 59 warning, you need paperwork for that and they don't have grounds to issue one unless there is more to the story. It'll only be an intelligence marker on ANPR.

Remember that an officer requires reasonable suspicion to search your vehicle. In the first case that was smelling cannabis. In future, if they want to search your car without your consent, ask on what grounds they are doing this. They should be able to explain why they have suspicions. Although you can be pulled over for a documents check, they can't search without further suspicions on top of the intel marker.
 
You'd have to be sat next to someone who's smoking for days before you started to feel an effect :p

I've sat in a room full of smokers and found myself... laughing at things which were not that funny. If you're a non-smoker the effects are going to be more pronounced.

I suspect the OP is a smoker though, as a non-smoker would never let people smoke in such a confined space where they were forced to participate, albeit passively.
Unless you're a complete mug of course.

We have a different culture and crucially different laws. Its illegal here so yes id say it was shameful to be breaking the law.

We get it ok, you don't like smoking. Nor do i, but i am not so incredibly precious over my car that i wouldn't let friends smoke in it.

If you smoke in a car you instantly halve the potential market for people to sell it to, and smoking in cars stains them permanently. If you are a non smoker why would you even want people smoking in your car?

Infact come to think of it, what sort of person WOULD smoke in somebody elses car unless they themselves were also smoking? I've got a few friends who smoke and never once have they asked if they could smoke in my car :confused:
 
I let one person smoke in my car once, because I knew if he didn't he'd be a total arse! Despite having the window open at motorway speeds I could still smell the smoke for a few weeks.

Smoking is a filthy disgusting habit, weather it be tobacco, weed or horse poo.

And to everyone who says I'm looking for sympathy or I'm "bitching" about this then I'm sorry but you are mistake. I agree that I was rightfully searched and I complied fully with the officers but when their results turned up nothing I could not see why (in my mind) I was being punished as I did not have anything in my possesion or in my system which they proved.

This thread was to get advice on how to check and how to remove myself if possible, to find out if they legally had grounds to put me on their "system" or not.


To the passive smoking comments: Windows down going above 30 and hardly any smoke stays in the car.

To the "smoking kills your car brigade": See above. I know it does damage over the long run, but with my regular cleaning and non-hotboxing I consider it a small price to pay for having the luxury of smoking a cig (something I enjoy) in my own car.

Also, Fox no I don't live in brum (I live about 25mins away though) why do you ask? Do they have different systems or you trying to stereotype:p

Even as a smoker I agree with that, it is however an enjoyable habit for those of us addicted to nicotine. Anyway, back on OT - I do actually have some sympathy for the OP however letting your mates smoke drugs in the car is always going to end in tears so my advice would be save it for your houses/somewhere out of the way that you can walk to NOT your car!!!!

I absolutely despise it, and if anyone lit up in my car they'd get a smack round the head and the number for the local taxi firm if I'm feeling generous as I pull up to let them out :p

Excellent attitude.

Some people are destined to be searched down with rubber gloves.
A little respect and if ever you are pulled you'll be on your way within a matter of minutes.

The police have seen it all before and will just take their time with you.

Oh please. Are some people this naive? Really?

Sometimes (more often than not in my experience) you'll catch a cop with such a chip on their shoulder that no amount of politeness will be able to get off. I've tried it in the past and it just doesn't work - You still end up being searched, talked to like dirt and generally messed about for not much reason other than Because they feel like it.

I've tried the nice and polite method in the past, now I'll be using the "Don't talk to the police" train of thought. Next time I'm pulled I'm handing over my documents, telling them my name, DOB and address, and then saying "No Comment" a lot - After all, If you've got nothing to hide why does it matter how you talk to them? :)
 
I have never once had any trouble with the police, ever. Every time I come into contact with them they are polite and well mannered.

I really do think that when a police officer first meets you, he gives you the attitude test. If you have a massive chip on your shoulder and you fail it, you wont have a happy experience. If you afford them the respect they deserve, you wont have any problems at all.

Ditto, in 8 years of driving I've only been pulled over a handful of times and never had a single cause for complaint. .

Yet there seem to be some people who have decided all cops are out to get them after only being on the road for a year or 2. There's only one differentiating factor there...

This is almost always the case. Sometimes you get someone who has just had a bad day but they're generally pretty rare. If you cooperate and are polite you'll get that in return, if only for the fact that after a 12 hour shift you just can't be bothered with the hassle.

You needed to read what else he wrote to realise what he meant, specifically where he said he didnt care if his mates had sex in the back when he was driving :p

I always thought that after a bad shift, a bit of courtesy and friendliness would go a long way, so I'll try to make conversation if I can
