police powers

Or maybe they haven't got any evidence they can tell you about.

That makes no sense. Firstly they can't have evidence about something that I was not involved with.

If they did have "all sorts" then why question me about what they did find at my colleague's address? Why wait until September to reveal what they found about me?

From what I gather from what my colleagues have told me about their interviews, it has been blown out of proportion. The police were tipped off about a huge scam that was going on involving many people and it has turned out to be just one man who was doing something "a bit naughty". I'm sorry I can't elaborate but as I said before, my solicitor said it will be settled with a fine and not a prison sentence so it's not very serious.

So they have at least some evidence implicating you. It doesn't mean you did it or that the evidence is right, but they do have to justify their arrests.

This is what I have a problem with. Say if I don't like you, I could just tell the police that you are committing fraud and a few days later you will be in the same position as I am in right now. Amazing.

To me, it seems that the main evidence they are after is on your computer. So you better hope they don't find anything they shouldnt.

I feel sorry for you though, to lose access to all that data for around 6 months.

But there was factual basis to the claim, so it's not like it was a plain lie.

And it would be a lot worse for me as I'd have the Professional Standards Department of Hampshire Constabulary investigating me too.

Are you a police officer? Is my IP address being traced right now and this link being sent to my local police station? :D

I suppose I'm just confused on how the legal system works. I get ripped off on ebay to the tune of £1400 and while the police take a statement they basically say "well there's nothing we can do". My garage gets broken into, items worth around £600 get stolen and they just offer me a crime number - they don't even send anyone around that day.

My mother suspected someone of stealing her £3000 diamond ring and while a police officer came around fairly quickly she was told "well I can ask the person you suspect to volenteer to a search but we can't force the person to empty their pockets". As it turned out my mother had just misplaced the ring :o

Absolutely amazing.

And he he means it. I'd hope they dont find ANYTHING naughty if i were you, from a cracked piece of software to a downloaded film..

You could end up with a piracy charge if that's found (one movie will be enough), even if you're innocent of the accused crime.

That's actually not true. I do have a few movies on there which I did tell the officers about but they laughed and said as long as you don't have thousands they aren't really interested.

Even then, they need to prove you're distributing it, otherwise it's a civil matter.

that was my thinking earlier, my mate got done for pictures left in his internet cache from a legit porn site, they got all but 1 girls birth cert in the end, cost him 10k plus for the girl they could not trace he had to pleed guilty to something or other...

So hypothetically if you worked with someone you suspected of fraudulently stealing money from you, or your business, what would you like to happen? Make them aware of it so they can dispose of the evidence? Wait until there is enough evidence to put it to trial, in which time they could have cleaned up? How would you gather this evidence?

The only reasonable way to catch someone doing fraudulent activity is to catch them off guard and seize what you can. This time, if you're innocent, it's going to be fruitless and the individual may have to explain themselves to the police or be charged themselves if nothing comes of the investigation.

If you didn't like someone and wanted to make a complaint you had better be sure there's substantial backing to the claim in the long run, because wasting police time is a criminal offence that isn't taken lightly. That's why people don't dupe the system, and generally people are accepting of the process of the law because they understand the steps that need to be taken in order to convict criminals.

It's a pain in the bum if you're innocent, sure. But it's necessary to catch those who aren't.
